    1- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ وَعَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ جَمِيعاً عَنِ ابْنِ مَحْبُوبٍ عَنْ جَمِيلِ بْنِ صَالِحٍ عَنْ أَبِي عُبَيْدَةَ قَالَ سَأَلْتُ أَبَا جَعْفَرٍ (عَلَيْهِ السَّلام) عَنْ رَجُلٍ كَانَتْ لَهُ ثَلاثُ بَنَاتٍ أَبْكَارٍ فَزَوَّجَ وَاحِدَةً مِنْهُنَّ رَجُلا وَلَمْ يُسَمِّ الَّتِي زَوَّجَ لِلزَّوْجِ وَلا لِلشُّهُودِ وَقَدْ كَانَ الزَّوْجُ فَرَضَ لَهَا صَدَاقَهَا فَلَمَّا بَلَغَ إِدْخَالُهَا عَلَى الزَّوْجِ بَلَغَ الرَّجُلَ أَنَّهَا الْكُبْرَى مِنَ الثَّلاثَةِ فَقَالَ الزَّوْجُ لأبِيهَا إِنَّمَا تَزَوَّجْتُ مِنْكَ الصُّغْرَى مِنْ بَنَاتِكَ قَالَ فَقَالَ أَبُو جَعْفَرٍ (عَلَيْهِ السَّلام) إِنْ كَانَ الزَّوْجُ رَآهُنَّ كُلَّهُنَّ وَلَمْ يُسَمَّ لَهُ وَاحِدَةٌ مِنْهُنَّ فَالْقَوْلُ فِي ذَلِكَ قَوْلُ الأبِ وَعَلَى الأبِ فِيمَا بَيْنَهُ وَبَيْنَ اللهِ أَنْ يَدْفَعَ إِلَى الزَّوْجِ الْجَارِيَةَ الَّتِي كَانَ نَوَى أَنْ يُزَوِّجَهَا إِيَّاهُ عِنْدَ عُقْدَةِ النِّكَاحِ وَإِنْ كَانَ الزَّوْجُ لَمْ يَرَهُنَّ كُلَّهُنَّ وَلَمْ يُسَمِّ وَاحِدَةً عِنْدَ عُقْدَةِ النِّكَاحِ فَالنِّكَاحُ بَاطِلٌ.

    1. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad and Ali ibn Ibrahim has narrated from his father all from ibn Mahbub from Jamil ibn Salih from abu ‘ Ubaydah who has said the following: “About the case of a man who has three virgin daughters and gives one of them in marriage to a man without identifying the girl for the husband or to the witnesses. The husband assigns a mahr (dower) for her. At the time for him to meet the girl he is informed that it is the oldest girl. He then says to the father, ‘I married the youngest of your daughters.’ Abu Ja’far, ‘Alayhi al-Salam, has said, ‘If the husband had seen them and did not identify one of them the words of the father are accepted between him and Allah to give in marriage the girl that he had intended at the time forming marriage terms. If the husband had not seen all of them and had not identified any one of them at the time of forming the terms of marriage, the marriage then is invalid.’”

    1- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ مُحَمَّدِ بْنِ خَالِدٍ عَنْ سَعْدِ بْنِ سَعْدٍ عَنْ مُحَمَّدِ بْنِ الْقَاسِمِ بْنِ فُضَيْلٍ عَنْ أَبِي الْحَسَنِ (عَلَيْهِ السَّلام) فِي الرَّجُلِ يَتَزَوَّجُ الْمَرْأَةَ عَلَى أَنَّهَا بِكْرٌ فَيَجِدُهَا ثَيِّباً أَيَجُوزُ لَهُ أَنْ يُقِيمَ عَلَيْهَا قَالَ فَقَالَ قَدْ تُفْتَقُ الْبِكْرُ مِنَ الْمَرْكَبِ وَمِنَ النَّزْوَةِ.

    1. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad ibn Khalid from Sa‘d ibn Sa‘d from Muhammad ibn al-Qasim ibn Fudayl who has said the following: “About the case of a man who marries a woman as a virgin but finds that she is not virgin; if it is permissible to live with her, abu al-Hassan has said, ‘At certain times it is torn because of riding or jumping.’”

    2- مُحَمَّدُ بْنُ يَحْيَى عَنْ عَبْدِ اللهِ بْنِ جَعْفَرٍ عَنْ مُحَمَّدِ بْنِ جَزَّكٍ قَالَ كَتَبْتُ إِلَى أَبِي الْحَسَنِ (عَلَيْهِ السَّلام) أَسْأَلُهُ عَنْ رَجُلٍ تَزَوَّجَ جَارِيَةً بِكْراً فَوَجَدَهَا ثَيِّباً هَلْ يَجِبُ لَهَا الصَّدَاقُ وَافِياً أَمْ يُنْتَقَصُ قَالَ يُنْتَقَصُ.

    2. Muhammad ibn Yahya has narrated from ‘Abd Allah ibn Ja’far from Muhammad ibn Jazzak who has said the following: “I once wrote to abu al-Hassan, ‘Alayhi al-Salam, and asked about the case of a man who married a virgin girl but found out that she was not virgin if it was obligatory to pay complete mahr (dower) or less. He (the Imam) answered, ‘It is less.’”

    1- مُحَمَّدُ بْنُ يَحْيَى عَنْ مُحَمَّدِ بْنِ الْحُسَيْنِ عَنْ مُحَمَّدِ بْنِ إِسْمَاعِيلَ عَنْ مَنْصُورِ بْنِ يُونُسَ عَنْ عَبْدِ الْحَمِيدِ بْنِ عَوَّاضٍ قَالَ قُلْتُ لأبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) أَتَزَوَّجُ الْمَرْأَةَ أَيَصْلُحُ لِي أَنْ أُوَاقِعَهَا وَلَمْ أَنْقُدْهَا مِنْ مَهْرِهَا شَيْئاً قَالَ نَعَمْ إِنَّمَا هُوَ دَيْنٌ عَلَيْكَ.

    1. Muhammad ibn Yahya has narrated from Muhammad ibn al-Husayn from Muhammad ibn ‘Isma’il from Mansur ibn Yunus from ‘Abd al-Hamid ibn ‘Awwad who has said the following: “This is concerning my question before abu ‘Abd Allah, ‘Alayhi al-Salam, about forming marriage terms with a woman; if I can go to bed with her without paying her anything in cash of her mahr (dower). He (the Imam) said, ‘Yes, you can do so, it is only a debt on you.’”

    2- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ وَعَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ جَمِيعاً عَنْ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ أَبِي نَصْرٍ قَالَ قُلْتُ لأبِي الْحَسَنِ (عَلَيْهِ السَّلام) الرَّجُلُ يَتَزَوَّجُ الْمَرْأَةَ عَلَى الصَّدَاقِ الْمَعْلُومِ يَدْخُلُ بِهَا قَبْلَ أَنْ يُعْطِيَهَا قَالَ يُقَدِّمُ إِلَيْهَا مَا قَلَّ أَوْ كَثُرَ إِلا أَنْ يَكُونَ لَهُ وَفَاءٌ مِنْ عَرَضٍ إِنْ حَدَثَ بِهِ حَدَثٌ أُدِّيَ عَنْهُ فَلا بَأْسَ.

    2. A number of our people have narrated from Sahl ibn Ziyad and Ali ibn Ibrahim has narrated from his father all from Ahmad ibn Muhammad from ibn abu Nasr who has said the following: “This is concerning my question before abu al-Hassan, ‘Alayhi al-Salam, about the case of a man who marries a woman for a certain amount of mahr (dower) and goes to bed with her without paying anything. He (the Imam) said, ‘He must pay in advance a little or more unless he has a certain asset which is enough to pay her mahr (dower) in case something happens to him, then it is not unlawful.’”

    3- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ بَعْضِ أَصْحَابِهِ عَنْ عَبْدِ الْحَمِيدِ الطَّائِيِّ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ قُلْتُ لَهُ أَتَزَوَّجُ الْمَرْأَةَ وَأَدْخُلُ بِهَا وَلا أُعْطِيهَا شَيْئاً قَالَ نَعَمْ يَكُونُ دَيْناً لَهَا عَلَيْكَ.

    3. Ali ibn Ibrahim has narrated from his father from ibn abu ‘Umayr from certain persons of his people from ‘Abd al-Hamid al-Ta’iy who has said the following: “This is concerning my question before abu ‘Abd Allah, ‘Alayhi al-Salam, if I can marry and go to bed with her without paying anything. He (the Imam) said, ‘Yes, you can do so and it is a debt on you.’”

    4- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ مُحَمَّدِ بْنِ عِيسَى عَنْ يُونُسَ عَنْ عَبْدِ الْحَمِيدِ بْنِ عَوَّاضٍ الطَّائِيِّ قَالَ سَأَلْتُ أَبَا عَبْدِ اللهِ (عَلَيْهِ السَّلام) عَنِ الرَّجُلِ يَتَزَوَّجُ الْمَرْأَةَ فَلا يَكُونُ عِنْدَهُ مَا يُعْطِيهَا فَيَدْخُلُ بِهَا قَالَ لا بَأْسَ إِنَّمَا هُوَ دَيْنٌ لَهَا عَلَيْهِ.

    4. Ali ibn Ibrahim has narrated from Muhammad ibn ‘Isa from Yunus from ‘Abd al-Hamid ibn ‘Awwad al-Ta’iy who has said the following: “This is concerning my question before abu ‘Abd Allah, ‘Alayhi al-Salam, about the case of a man who marries a woman and does not have anything to pay her and then goes to bed with her. He (the Imam) said, ‘It is not unlawful; it is a debt on him.’”

    1- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ وَعَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ جَمِيعاً عَنْ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ أَبِي نَصْرٍ قَالَ قُلْتُ لأبِي الْحَسَنِ (عَلَيْهِ السَّلام) قَوْلُ شُعَيْبٍ (عَلَيْهِ السَّلام) إِنِّي أُرِيدُ أَنْ أُنْكِحَكَ إِحْدَى ابْنَتَيَّ هاتَيْنِ عَلى‏ أَنْ تَأْجُرَنِي ثَمانِيَ حِجَجٍ فَإِنْ أَتْمَمْتَ عَشْراً فَمِنْ عِنْدِكَ أَيَّ الأجَلَيْنِ قَضَى قَالَ الْوَفَاءُ مِنْهُمَا أَبْعَدُهُمَا عَشْرُ سِنِينَ قُلْتُ فَدَخَلَ بِهَا قَبْلَ أَنْ يَنْقَضِيَ الشَّرْطُ أَوْ بَعْدَ انْقِضَائِهِ قَالَ قَبْلَ أَنْ يَنْقَضِيَ قُلْتُ لَهُ فَالرَّجُلُ يَتَزَوَّجُ الْمَرْأَةَ وَيَشْتَرِطُ لأبِيهَا إِجَارَةَ شَهْرَيْنِ يَجُوزُ ذَلِكَ فَقَالَ إِنَّ مُوسَى (عَلَيْهِ السَّلام) قَدْ عَلِمَ أَنَّهُ سَيُتِمُّ لَهُ شَرْطَهُ فَكَيْفَ لِهَذَا بِأَنْ يَعْلَمَ أَنَّهُ سَيَبْقَى حَتَّى يَفِيَ لَهُ وَقَدْ كَانَ الرَّجُلُ عَلَى عَهْدِ رَسُولِ اللهِ (صَلَّى اللهُ عَلَيْهِ وَآلِه) يَتَزَوَّجُ الْمَرْأَةَ عَلَى السُّورَةِ مِنَ الْقُرْآنِ وَعَلَى الدِّرْهَمِ وَعَلَى الْقَبْضَةِ مِنَ الْحِنْطَةِ.

    1. A number of our people have narrated from Sahl ibn Ziyad and Ali ibn Ibrahim has narrated from his father all from Ahmad ibn Muhammad from ibn abu Nasr who has said the following: “I once asked abu al-Hassan, ‘Alayhi al-Salam, about the meaning of the words of Shu‘ayb, ‘(Shu‘ayb) said to (Moses), “I want to give one of my daughters to you in marriage on the condition that you will work for me for eight years, but you may continue for two more years only out of your own accord’” (28:27) and that which one of the terms he completed. He (the Imam) said, ‘Completion was of the longest term which was ten years.’ I then asked, ‘Did he go to bed before completing the term or afterwards?’ He (the Imam) said, ‘It was before completing the terms.’ I then asked, ‘If a man marries a woman and stipulates with her father for the wages of two months if it is permissible.’ He (the Imam) said, ‘Moses knew that he will complete the terms. How can this man know that he remains alive until the time of paying? At the time of the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, people married women for teaching a chapter of al-Quran, for one dirham and for one handful of wheat.’”

  9. 9726Al-Kafi

    2- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ النَّوْفَلِيِّ عَنِ السَّكُونِيِّ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ لا يَحِلُّ النِّكَاحُ الْيَوْمَ فِي الإسْلامِ بِإِجَارَةٍ أَنْ يَقُولَ أَعْمَلُ عِنْدَكَ كَذَا وَكَذَا سَنَةً عَلَى أَنْ تُزَوِّجَنِي ابْنَتَكَ أَوْ أُخْتَكَ قَالَ حَرَامٌ لأنَّهُ ثَمَنُ رَقَبَتِهَا وَهِيَ أَحَقُّ بِمَهْرِهَا.

    2. Ali ibn Ibrahim has narrated from his father from al-Nawfaliy from al-Sakuniy who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘Marriage is not lawful in Islam for hiring and saying, ‘I will work for you up to so and so many years and you give to me in marriage your daughter or sister.’ He (the Imam) said, ‘It is unlawful because it is the price of her neck and in fact she is the rightful person for her mahr (dower).”’

    1- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنِ الْحَسَنِ بْنِ عَلِيٍّ عَنْ عَبْدِ اللهِ بْنِ بُكَيْرٍ عَنْ بَعْضِ أَصْحَابِنَا عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) فِي رَجُلٍ أَرْسَلَ يَخْطُبُ إِلَيْهِ امْرَأَةً وَهُوَ غَائِبٌ فَأَنْكَحُوا الْغَائِبَ وَفُرِضَ الصَّدَاقُ ثُمَّ جَاءَ خَبَرُهُ بَعْدُ أَنَّهُ تُوُفِّيَ بَعْدَ مَا سَبَقَ الصَّدَاقُ فَقَالَ إِنْ كَانَ أُمْلِكَ بَعْدَ مَا تُوُفِّيَ فَلَيْسَ لَهَا صَدَاقٌ وَلا مِيرَاثٌ وَإِنْ كَانَ أُمْلِكَ قَبْلَ أَنْ يُتَوَفَّى فَلَهَا نِصْفُ الصَّدَاقِ وَهِيَ وَارِثُهُ وَعَلَيْهَا الْعِدَّةُ.

    1. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from al-Hassan ibn Ali from ‘Abd Allah ibn Bukayr from certain persons of our people who has said the following: “About the case of a man who sends a proposal for marriage and he is absent. They give her in marriage to one who is absent and assign mahr (dower) but then news comes that he is dead after assigning mahr (dower). He (the Imam) said, Tf his earning is after his death she has no mahr (dower) or inheritance but if his earning is before his death then she deserves half of mahr (dower) and she inherits him.”’

    1- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ عَلِيِّ بْنِ الْحَكَمِ عَنِ الْعَلاءِ بْنِ رَزِينٍ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَحَدِهِمَا (عَلَيْهِما السَّلام) أَنَّهُ سُئِلَ عَنِ الرَّجُلِ يَفْجُرُ بِالْمَرْأَةِ أَيَتَزَوَّجُ ابْنَتَهَا قَالَ لا وَلَكِنْ إِنْ كَانَتْ عِنْدَهُ امْرَأَةٌ ثُمَّ فَجَرَ بِأُمِّهَا أَوِ ابْنَتِهَا أَوْ أُخْتِهَا لَمْ تَحْرُمْ عَلَيْهِ امْرَأَتُهُ إِنَّ الْحَرَامَ لا يُفْسِدُ الْحَلالَ.

    1. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from al-‘Ala’ ibn Razin from Muhammad ibn Muslim who has said the following: “One of the two Imam, (abu Ja’far or abu ‘Abd Allah), ‘Alayhim al-Salam, was asked about the case of a man who went to bed with a woman out of wedlock; if he could marry her daughter. He (the Imam) said, ‘No, however, if a woman is his wife and he goes to bed with her mother or her daughter or sister, his wife does not become unlawful for him because unlawful does not destroy what is lawful. 5 ”

    2- أَبُو عَلِيٍّ الأشْعَرِيُّ عَنْ مُحَمَّدِ بْنِ عَبْدِ الْجَبَّارِ وَمُحَمَّدُ بْنُ إِسْمَاعِيلَ عَنِ الْفَضْلِ بْنِ شَاذَانَ جَمِيعاً عَنْ صَفْوَانَ بْنِ يَحْيَى عَنْ عِيصِ بْنِ الْقَاسِمِ قَالَ سَأَلْتُ أَبَا عَبْدِ اللهِ (عَلَيْهِ السَّلام) عَنْ رَجُلٍ بَاشَرَ امْرَأَةً وَقَبَّلَ غَيْرَ أَنَّهُ لَمْ يُفْضِ إِلَيْهَا ثُمَّ تَزَوَّجَ ابْنَتَهَا قَالَ إِذَا لَمْ يَكُنْ أَفْضَى إِلَى الأمِّ فَلا بَأْسَ وَإِنْ كَانَ أَفْضَى إِلَيْهَا فَلا يَتَزَوَّجِ ابْنَتَهَا.

    2. Abu Ali al-Ash’ariy has narrated from Muhammad ibn ‘Abd al-Jabbar and Muhammad ibn ‘Isma’il has narrated from al-Fadl ibn Shadhan from all from Safwan ibn Yahya from ‘Is ibn al-Qasim who has said the following: “This is concerning my question before abu ‘Abd Allah, ‘Alayhi al-Salam, about the case of a man who associates with a woman and kisses her but does not go to bed with her; if he can marry her daughter. He (the Imam) said, ‘If he has not gone to bed with the mother, it is not unlawful to marry her but if he has gone to bed with her mother then he must not marry her (the daughter).’”

    3- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ حَمَّادٍ عَنِ الْحَلَبِيِّ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) فِي رَجُلٍ تَزَوَّجَ جَارِيَةً فَدَخَلَ بِهَا ثُمَّ ابْتُلِيَ بِهَا فَفَجَرَ بِأُمِّهَا أَتَحْرُمُ عَلَيْهِ امْرَأَتُهُ فَقَالَ لا إِنَّهُ لا يُحَرِّمُ الْحَلالَ الْحَرَامُ.

    3. Ali ibn Ibrahim has narrated from his father from ibn abu ‘Umayr from Hammad from al-Halabiy who has said the following: “About the case of a man who marries a girl then goes to bed with her, then due to wickedness goes to bed with her mother; if she becomes unlawful for him, abu Ja‘far, ‘Alayhi al-Salam, has said, ‘His wife does not become unlawful for him.’ He (the Imam) then said, ‘Unlawful never makes a lawful thing unlawful.’”

    4- عَلِيٌّ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ عُمَرَ بْنِ أُذَيْنَةَ عَنْ زُرَارَةَ عَنْ أَبِي جَعْفَرٍ (عَلَيْهِ السَّلام) أَنَّهُ قَالَ فِي رَجُلٍ زَنَى بِأُمِّ امْرَأَتِهِ أَوْ بِابْنَتِهَا أَوْ بِأُخْتِهَا فَقَالَ لا يُحَرِّمُ ذَلِكَ عَلَيْهِ امْرَأَتَهُ ثُمَّ قَالَ مَا حَرَّمَ حَرَامٌ قَطُّ حَلالا.

    4. Ali ibn Ibrahim has narrated from his father from ibn abu ‘Umayr from ibn ‘Udhaynah from Zurarah who has said the following: “About the case of a man who goes to bed with his mother-in-law or his stepdaughter or her sister, abu Ja’far ‘Alayhi al-Salam, has said, ‘This does not make his wife unlawful for him.’ He (the Imam) then said, ‘Unlawful does not make a lawful thing unlawful.’”

    5- أَبُو عَلِيٍّ الأشْعَرِيُّ عَنْ مُحَمَّدِ بْنِ عَبْدِ الْجَبَّارِ عَنْ صَفْوَانَ عَنْ مَنْصُورِ بْنِ حَازِمٍ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) فِي رَجُلٍ كَانَ بَيْنَهُ وَبَيْنَ امْرَأَةٍ فُجُورٌ فَهَلْ يَتَزَوَّجُ ابْنَتَهَا فَقَالَ إِنْ كَانَ مِنْ قُبْلَةٍ أَوْ شِبْهِهَا فَلْيَتَزَوَّجِ ابْنَتَهَا وَإِنْ كَانَ جِمَاعاً فَلا يَتَزَوَّجِ ابْنَتَهَا وَلْيَتَزَوَّجْهَا هِيَ إِنْ شَاءَ.

    5. Abu Ali al-Ash’ariy has narrated from Muhammad ibn ‘Abd al-Jabbar from Safwan from Mansur ibn Hazim who has said the following: “About the case of a man and a woman who are involved in sinful activities; if he can marry her daughter, abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘If such activities are in the form of kissing or similar things he can marry her daughter; but if it is sexual intercourse then he must not marry her daughter, he can, however, marry the woman if he wants.’”

    6- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ عَنِ ابْنِ مَحْبُوبٍ عَنْ عَلِيِّ بْنِ رِئَابٍ عَنْ زُرَارَةَ قَالَ سَأَلْتُ أَبَا جَعْفَرٍ (عَلَيْهِ السَّلام) عَنْ رَجُلٍ زَنَى بِأُمِّ امْرَأَتِهِ أَوْ بِأُخْتِهَا فَقَالَ لا يُحَرِّمُ ذَلِكَ عَلَيْهِ امْرَأَتَهُ إِنَّ الْحَرَامَ لا يُفْسِدُ الْحَلالَ وَلا يُحَرِّمُهُ.

    6. A number of our people have narrated from Sahl ibn Ziyad from ibn Mahbub from ibn Ri’ab from Zurarah who has said the following: “This is concerning my question before abu Ja‘far, ‘Alayhi al-Salam, about the case of a man who goes to bed with the mother of his wife or her sister. He (the Imam) said, ‘This does not make his wife unlawful for him; unlawful does not destroy or make lawful ones unlawful.’”

Al-Husayn from Muhammad has narrated from Mu’alla’ ibn Muhammad from certain persons of his people from Aban ibn ‘Uthman from Mansur ibn Hazim who has said the following: “This is concerning my question before abu ‘ Abd Allah, ‘Alayhi al-Salam, about the case of a man and a woman who are involved in sinful acts. He (the Imam) said, Tf such activities are in the form of kissing or similar things he can marry her daughter; but if it is sexual intercourse then he must not marry her daughter, he can, however, marry the woman if he wants.”’

    8- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ عَلِيِّ بْنِ الْحَكَمِ عَنِ الْعَلاءِ بْنِ رَزِينٍ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَحَدِهِمَا (عَلَيْهِما السَّلام) قَالَ سَأَلْتُهُ عَنْ رَجُلٍ فَجَرَ بِامْرَأَةٍ أَيَتَزَوَّجُ أُمَّهَا مِنَ الرَّضَاعَةِ أَوِ ابْنَتَهَا قَالَ لا. مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنِ ابْنِ مَحْبُوبٍ عَنِ الْعَلاءِ بْنِ رَزِينٍ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَبِي جَعْفَرٍ (عَلَيْهِ السَّلام) مِثْلَهُ.

    8. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from al-‘Ala’ ibn Razin from Muhammad ibn Muslim who has said the following: “I once asked one of the two Imam, (abu Ja’far or abu ‘Abd Allah), ‘Alayhim al-Salam, about the case of a man who had committed sinful acts with a woman if he could marry her breastfeeding mother or daughter. He (the Imam) said, ‘No, he cannot do so.’ Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ibn Mahbub from al-‘Ala’ ibn Razin from Muhammad ibn Muslim a similar Hadith.”

    9- ابْنُ مَحْبُوبٍ عَنْ هِشَامِ بْنِ سَالِمٍ عَنْ يَزِيدَ الْكُنَاسِيِّ قَالَ إِنَّ رَجُلا مِنْ أَصْحَابِنَا تَزَوَّجَ امْرَأَةً فَقَالَ لِي أُحِبُّ أَنْ تَسْأَلَ أَبَا عَبْدِ اللهِ (عَلَيْهِ السَّلام) وَتَقُولَ لَهُ إِنَّ رَجُلا مِنْ أَصْحَابِنَا تَزَوَّجَ امْرَأَةً قَدْ زَعَمَ أَنَّهُ كَانَ يُلاعِبُ أُمَّهَا وَيُقَبِّلُهَا مِنْ غَيْرِ أَنْ يَكُونَ أَفْضَى إِلَيْهَا قَالَ فَسَأَلْتُ أَبَا عَبْدِ اللهِ (عَلَيْهِ السَّلام) فَقَالَ لِي كَذَبَ مُرْهُ فَلْيُفَارِقْهَا قَالَ فَرَجَعْتُ مِنْ سَفَرِي فَأَخْبَرْتُ الرَّجُلَ بِمَا قَالَ أَبُو عَبْدِ اللهِ (عَلَيْهِ السَّلام) فَوَ اللهِ مَا دَفَعَ ذَلِكَ عَنْ نَفْسِهِ وَخَلَّى سَبِيلَهَا.

    9. Ibn Mahbub has narrated from Hisham ibn Salim from Yazid al-Kunnasiy who has said the following: “A certain person of our people married a woman and said to me, ‘I like if you ask abu ‘Abd Allah, ‘Alayhi al-Salam, about the case of a man from our people who has married a woman and thinks that he may have played with her mother like kissing without sexual intercourse.’ He (the narrator) has said, ‘I asked abu ‘Abd Allah, ‘Alayhi al-Salam, about it and he said, ‘He has lied. Tell him to separate from her.’ I returned from my journey and informed the man of what abu ‘Abd Allah, ‘Alayhi al- Salam, had said. By Allah, he did not defend himself and sent her to go away.’”

    10- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ أَبِي أَيُّوبَ الْخَرَّازِ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ قَالَ سَأَلَ رَجُلٌ أَبَا عَبْدِ اللهِ (عَلَيْهِ السَّلام) وَأَنَا جَالِسٌ عَنْ رَجُلٍ نَالَ مِنْ خَالَتِهِ فِي شَبَابِهِ ثُمَّ ارْتَدَعَ أَيَتَزَوَّجُ ابْنَتَهَا فَقَالَ لا قُلْتُ إِنَّهُ لَمْ يَكُنْ أَفْضَى إِلَيْهَا إِنَّمَا كَانَ شَيْ‏ءٌ دُونَ شَيْ‏ءٍ فَقَالَ لا يُصَدَّقُ وَلا كَرَامَةَ.

    10. Ali ibn Ibrahim has narrated from his father from ibn abu ‘Umayr from abu Ayyub al-Khazzaz from Muhammad ibn Muslim who has said the following: “Once, a man asked abu ‘Abd Allah, ‘Alayhi al-Salam, when I was sitting, about the case of a man who when young was involved with his maternal aunt then refrained, if he could marry her daughter. He (the Imam) said, ‘No, he cannot do so.’ He then asked, ‘What happens if there was no sexual intercourse, but it was something near the thing?’ He (the Imam) said, ‘No, his words are not accepted, and it is not honorable.’”

Al-Husayn from Muhammad has narrated from Mu’alla’ ibn Muhammad from al-Hassan ibn Ali from Hammad ibn ‘Uthaman who has said the following: “This is concerning my question before abu ‘ Abd Allah, ‘Alayhi al-Salam, about the case of a man who commits sinful act with a boy; if he can marry his sister. He (the Imam) said, Tf he made a hole, then he cannot do so (marry).’”

    3- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ أَوْ عَنْ مُحَمَّدِ بْنِ عَلِيٍّ عَنْ مُوسَى بْنِ سَعْدَانَ عَنْ بَعْضِ رِجَالِهِ قَالَ كُنْتُ عِنْدَ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) فَأَتَاهُ رَجُلٌ فَقَالَ لَهُ جُعِلْتُ فِدَاكَ مَا تَرَى فِي شَابَّيْنِ كَانَا مُضْطَجِعَيْنِ فَوُلِدَ لِهَذَا غُلامٌ وَلِلآخَرِ جَارِيَةٌ أَيَتَزَوَّجُ ابْنُ هَذَا ابْنَةَ هَذَا قَالَ فَقَالَ نَعَمْ سُبْحَانَ اللهِ لِمَ لا يَحِلُّ فَقَالَ إِنَّهُ كَانَ صَدِيقاً لَهُ قَالَ فَقَالَ وَإِنْ كَانَ فَلا بَأْسَ قَالَ فَقَالَ فَإِنَّهُ كَانَ يَفْعَلُ بِهِ قَالَ فَأَعْرَضَ بِوَجْهِهِ [عَنْهُ] ثُمَّ أَجَابَهُ وَهُوَ مُسْتَتِرٌ بِذِرَاعَيْهِ فَقَالَ إِنْ كَانَ الَّذِي كَانَ مِنْهُ دُونَ الإيقَابِ فَلا بَأْسَ أَنْ يَتَزَوَّجَ وَإِنْ كَانَ قَدْ أَوْقَبَ فَلا يَحِلُّ لَهُ أَنْ يَتَزَوَّجَ‏.

    3. Ali ibn Ibrahim has narrated from his father or from Muhammad ibn Ali from Musa ibn Sa‘dan from certain persons of his people who have said the following: “Once I was with abu ‘Abd Allah, ‘Alayhi al-Salam, when a man came and said, ‘I pray to Allah to keep my soul in service for your cause, if two young men slept together and one has a son and the other has a daughter; if his son could marry the other man’s daughter.’ He (the narrator) has said that he (the Imam) said, ‘Yes, Allah is free of all defects, why can it be unlawful?’ The man said they were friends. He (the Imam) said, ‘Even if such is the case it is not unlawful.’ The man said, ‘He was doing to him.’ He (the Imam) turned away his face then, while covering his face with his arms, said, ‘Even if it was what it was without doing the hole it is not unlawful to marry but if awqaba (made a hole in him) then marriage is not lawful.’”

Ali ibn Ibrahim has narrated from his father from ibn abu ‘Umayr from Hammad from af-Halabiy who has said the following: “This is concerning my question before abu ‘ Abd Allah, ‘Alayhi al-Salam, about the case of a man who marries a woman and has touched her. He (the Imam) said, ‘Her mahr (dower) is obligatory and she becomes unlawful for marriage to his father and his son.’”

    2- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ مُحَمَّدِ بْنِ إِسْمَاعِيلَ قَالَ سَأَلْتُ أَبَا الْحَسَنِ الرِّضَا (عَلَيْهِ السَّلام) عَنِ الرَّجُلِ تَكُونُ لَهُ الْجَارِيَةُ فَيُقَبِّلُهَا هَلْ تَحِلُّ لِوَلَدِهِ قَالَ بِشَهْوَةٍ قُلْتُ نَعَمْ قَالَ فَقَالَ مَا تَرَكَ شَيْئاً إِذَا قَبَّلَهَا بِشَهْوَةٍ ثُمَّ قَالَ ابْتِدَاءً مِنْهُ إِنْ جَرَّدَهَا وَنَظَرَ إِلَيْهَا بِشَهْوَةٍ حَرُمَتْ عَلَى أَبِيهِ وَابْنِهِ قُلْتُ إِذَا نَظَرَ إِلَى جَسَدِهَا فَقَالَ إِذَا نَظَرَ إِلَى فَرْجِهَا وَجَسَدِهَا بِشَهْوَةٍ حَرُمَتْ عَلَيْهِ.

    2. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Muhammad ibn ‘Isma’il who has said the following: “I once asked al-Rida’, ‘Alayhi al-Salam, about the case of a man who had a slave-girl and he kissed her; if she was lawful for his sons. He (the Imam) asked, ‘Was it with lust?’ I replied, ‘Yes, it was with lust.’ He (the Imam) said, ‘He then has left nothing if he has kissed with lust.’ He (the Imam) then initiating said, ‘If he makes her bare and looks at her with lust she becomes unlawful to marry for his father and his son.’ I then asked, ‘What happens if he looks at her body?’ He (the Imam) said, ‘If he looks at her vagina and body with lust she becomes unlawful for him.’”

Ali ibn Ibrahim has narrated from his father from ibn abu ‘Umayr from Jamil ibn Darraj who has said the following: “This is concerning my question before abu ‘Abd Allah, ‘Alayhi al-Salam, about the case of a man who looks at a slave-girl whom he wants to buy; if she is lawful for his son. He (the Imam) said, ‘Yes, she is lawful unless he has looked at her private organs.”’

    4- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ عَلِيِّ بْنِ الْحَكَمِ عَنْ عَبْدِ اللهِ بْنِ يَحْيَى الْكَاهِلِيِّ قَالَ سُئِلَ أَبُو عَبْدِ اللهِ (عَلَيْهِ السَّلام) وَأَنَا عِنْدَهُ عَنْ رَجُلٍ اشْتَرَى جَارِيَةً وَلَمْ يَمَسَّهَا فَأَمَرَتِ امْرَأَتُهُ ابْنَهُ وَهُوَ ابْنُ عَشْرِ سِنِينَ أَنْ يَقَعَ عَلَيْهَا فَوَقَعَ عَلَيْهَا فَمَا تَرَى فِيهِ فَقَالَ أَثِمَ الْغُلامُ وَأَثِمَتْ أُمُّهُ وَلا أَرَى لِلأبِ إِذَا قَرِبَهَا الابْنُ أَنْ يَقَعَ عَلَيْهَا قَالَ وَسَأَلْتُهُ عَنْ رَجُلٍ يَكُونُ لَهُ جَارِيَةٌ فَيَضَعُ أَبُوهُ يَدَهُ عَلَيْهَا مِنْ شَهْوَةٍ أَوْ يَنْظُرُ مِنْهَا إِلَى مُحَرَّمٍ مِنْ شَهْوَةٍ فَكَرِهَ أَنْ يَمَسَّهَا ابْنُهُ.

    4. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from ‘Abd Allah ibn Yahya al-Kahiliy who has said the following: “Once abu ‘Abd Allah, ‘Alayhi al-Salam, was asked, when I was with him (the Imam), about the case of a man who bought a slave-girl but did not touch her. His wife commanded his son, who was ten years old, to fall on her (for sexual intercourse) and he did it, now what do you say about it. He (the Imam) said, ‘The boy has sinned as well as his mother and it is not permissible for the father, after his son’s going near her, to fall on her.’ I then asked him (the Imam) about the case of a man who has a slave-girl and his father places his hand on her with lust or looks where it is not permissible to look with lust. He (the Imam) disliked his son’s touching her.’”

Muhammad ibn ‘Isma’il has narrated from al-Fadl ibn Shadhan from ibn abu ‘Umayr from Rib’iy ibn ‘Abd Allah from Muhammad ibn Muslim who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘If a man makes a slave-girl bare and places his hand on her she becomes unlawful for his son.’”

    7- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ عَلِيِّ بْنِ الْحَكَمِ عَنْ مُوسَى بْنِ بَكْرٍ عَنْ زُرَارَةَ قَالَ قَالَ أَبُو جَعْفَرٍ (عَلَيْهِ السَّلام) إِذَا زَنَى رَجُلٌ بِامْرَأَةِ أَبِيهِ أَوْ جَارِيَةِ أَبِيهِ فَإِنَّ ذَلِكَ لا يُحَرِّمُهَا عَلَى زَوْجِهَا وَلا تُحَرِّمُ الْجَارِيَةَ عَلَى سَيِّدِهَا إِنَّمَا يُحَرِّمُ ذَلِكَ مِنْهُ إِذَا أَتَى الْجَارِيَةَ وَهِيَ حَلالٌ فَلا تَحِلُّ تِلْكَ الْجَارِيَةُ أَبَداً لابْنِهِ وَلا لأبِيهِ وَإِذَا تَزَوَّجَ رَجُلٌ امْرَأَةً تَزْوِيجاً حَلالا فَلا تَحِلُّ تِلْكَ الْمَرْأَةُ لأبِيهِ وَلابْنِهِ.

    7. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from Musa ibn Bakr from Zurarah who has said the following: “Abu Ja‘far, ‘Alayhi al-Salam, has said, ‘If a man commits fornication with the woman of his father or his slave-girl, it does not make her unlawful to her husband or the slave-girl unlawful to her master. If he goes to bed with a slave-girl who is lawful thereafter she becomes unlawful forever to his son and father. If a man marries a woman in a lawful way, that woman is not lawful for his father and son for marriage.

    8- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ عَنْ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ أَبِي نَصْرٍ عَنْ حَمَّادِ بْنِ عُثْمَانَ عَنْ مُرَازِمٍ قَالَ سَمِعْتُ أَبَا عَبْدِ اللهِ (عَلَيْهِ السَّلام) وَسُئِلَ عَنِ امْرَأَةٍ أَمَرَتِ ابْنَهَا أَنْ يَقَعَ عَلَى جَارِيَةٍ لأبِيهِ فَوَقَعَ فَقَالَ أَثِمَتْ وَأَثِمَ ابْنُهَا وَقَدْ سَأَلَنِي بَعْضُ هَؤُلاءِ عَنْ هَذِهِ الْمَسْأَلَةِ فَقُلْتُ لَهُ أَمْسِكْهَا إِنَّ الْحَلالَ لا يُفْسِدُهُ الْحَرَامُ.

    8. A number of our people have narrated from Sahl ibn Ziyad from Ahmad ibn Muhammad from ibn abu Nasr from Hammad ibn ‘Uthaman from Murazim who has said the following: “I once heard abu ‘Abd Allah, ‘Alayhi al-Salam, saying, when he (the Imam) was asked about the case of a woman who commanded her son to fall on the slave-girl of his father and he did, ‘She has sinned and so has her son and certain ones of these people asked me about it and I said, “You can keep her because unlawful does not make lawful ones unlawful.’””

    9- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ عَنْ مُوسَى بْنِ جَعْفَرٍ عَنْ عَمْرِو بْنِ سَعِيدٍ عَنْ مُصَدِّقِ بْنِ صَدَقَةَ عَنْ عَمَّارٍ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) فِي الرَّجُلِ تَكُونُ لَهُ الْجَارِيَةُ فَيَقَعُ عَلَيْهَا ابْنُ ابْنِهِ قَبْلَ أَنْ يَطَأَهَا الْجَدُّ أَوِ الرَّجُلُ يَزْنِي بِالْمَرْأَةِ فَهَلْ يَحِلُّ لأبِيهِ أَنْ يَتَزَوَّجَهَا قَالَ لا إِنَّمَا ذَلِكَ إِذَا تَزَوَّجَهَا الرَّجُلُ فَوَطِئَهَا ثُمَّ زَنَى بِهَا ابْنُهُ لَمْ يَضُرَّهُ لأنَّ الْحَرَامَ لا يُفْسِدُ الْحَلالَ وَكَذَلِكَ الْجَارِيَةُ.

    9. A number of our people have narrated from Sahl ibn Ziyad from Musa ibn Ja’far from “Amr ibn Sa‘id from Musaddiq ibn Sadaqah from ‘Ammar who has said the following: “About the case of a man who has a slave-girl and his grandson falls on her (does sexual intercourse) before his grandfather or that a man commits fornication with a woman; if she is lawful for his father to marry, abu ‘Abd Allah, ‘Alayhi al-Salam, said, ‘No, it is not permissible. Only if the man marries her and goes to bed with her then his son commits fornication with her it does not harm him because unlawful does not make lawful ones unlawful and so also is the case of the slave-girl.’”

    1- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ عَلِيِّ بْنِ الْحَكَمِ عَنِ الْعَلاءِ بْنِ رَزِينٍ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَحَدِهِمَا (عَلَيْهِما السَّلام) أَنَّهُ قَالَ لَوْ لَمْ يَحْرُمْ عَلَى النَّاسِ أَزْوَاجُ النَّبِيِّ (صَلَّى اللهُ عَلَيْهِ وَآلِه) لِقَوْلِ اللهِ عَزَّ وَجَلَّ وَما كانَ لَكُمْ أَنْ تُؤْذُوا رَسُولَ اللهِ وَلا أَنْ تَنْكِحُوا أَزْواجَهُ مِنْ بَعْدِهِ أَبَداً حَرُمْنَ عَلَى الْحَسَنِ وَالْحُسَيْنِ (عَلَيْهِما السَّلام) لِقَوْلِ اللهِ عَزَّ وَجَلَّ وَلا تَنْكِحُوا ما نَكَحَ آباؤُكُمْ مِنَ النِّساءِ وَلا يَصْلُحُ لِلرَّجُلِ أَنْ يَنْكِحَ امْرَأَةَ جَدِّهِ.

    1. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from al-‘Ala’ ibn Razin from Muhammad ibn Muslim who has said the following: “One of the two Imam, (abu Ja’far or abu ‘Abd Allah), ‘Alayhim al-Salam, has said, ’If the wives of the Holy Prophet, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, were not made unlawful for people to marry because of the words of Allah, most Majestic, most Glorious, “You must not cause pain to the Messenger of Allah and never marry his wives after him” (33:53) they were unlawful for al-Hassan and al-Husayn, ‘Alayhi al-Salam, because of the words of Allah, most Majestic, most Glorious, “You must not marry whoever your fathers have married.” (4:22)’”

    2- الْحُسَيْنُ بْنُ مُحَمَّدٍ عَنْ مُعَلَّى بْنِ مُحَمَّدٍ عَنِ الْحَسَنِ بْنِ عَلِيٍّ عَنْ أَبَانِ بْنِ عُثْمَانَ عَنْ أَبِي الْجَارُودِ قَالَ سَمِعْتُ أَبَا عَبْدِ اللهِ (عَلَيْهِ السَّلام) يَقُولُ وَذَكَرَ هَذِهِ الآيَةَ وَوَصَّيْنَا الإنْسانَ بِوالِدَيْهِ حُسْناً فَقَالَ رَسُولُ اللهِ (صَلَّى اللهُ عَلَيْهِ وَآلِه) أَحَدُ الْوَالِدَيْنِ فَقَالَ عَبْدُ اللهِ بْنُ عَجْلانَ مَنِ الآخَرُ قَالَ عَلِيٌّ (عَلَيْهِ السَّلام) وَنِسَاؤُهُ عَلَيْنَا حَرَامٌ وَهِيَ لَنَا خَاصَّةً.

    2. Al-Husayn from Muhammad has narrated from Mu’alla’ ibn Muhammad from al-Hassan ibn Ali from Aban ibn ‘Uthman from abu al-Jarud who has said the following: “I once heard abu ‘ Abd Allah, ‘Alayhi al-Salam, saying, when this verse was mentioned, ‘We advised the man about his (two fathers) parents’, (29:7) ‘The Messenger of Allah is one of the (two fathers) parents.’ ‘Who is the other (father) parent?’ ‘Abd Allah ibn ‘Ajalan then asked. He (the Imam) replied ‘Ali, ‘Alayhi al-Salam, is the other (father) parent. His women are unlawful to us and this (verse) is especially for us.’”

    3- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ عُمَرَ بْنِ أُذَيْنَةَ قَالَ حَدَّثَنِي سَعْدُ بْنُ أَبِي عُرْوَةَ عَنْ قَتَادَةَ عَنِ الْحَسَنِ الْبَصْرِيِّ أَنَّ رَسُولَ اللهِ (صَلَّى اللهُ عَلَيْهِ وَآلِه) تَزَوَّجَ امْرَأَةً مِنْ بَنِي عَامِرِ بْنِ صَعْصَعَةَ يُقَالُ لَهَا سَنَى وَكَانَتْ مِنْ أَجْمَلِ أَهْلِ زَمَانِهَا فَلَمَّا نَظَرَتْ إِلَيْهَا عَائِشَةُ وَحَفْصَةُ قَالَتَا لَتَغْلِبُنَا هَذِهِ عَلَى رَسُولِ اللهِ (صَلَّى اللهُ عَلَيْهِ وَآلِه) بِجَمَالِهَا فَقَالَتَا لَهَا لا يَرَى مِنْكِ رَسُولُ اللهِ (صَلَّى اللهُ عَلَيْهِ وَآلِه) حِرْصاً فَلَمَّا دَخَلَتْ عَلَى رَسُولِ اللهِ (صَلَّى اللهُ عَلَيْهِ وَآلِه) تَنَاوَلَهَا بِيَدِهِ فَقَالَتْ أَعُوذُ بِاللهِ فَانْقَبَضَتْ يَدُ رَسُولِ اللهِ (صَلَّى اللهُ عَلَيْهِ وَآلِه) عَنْهَا فَطَلَّقَهَا وَأَلْحَقَهَا بِأَهْلِهَا وَتَزَوَّجَ رَسُولُ اللهِ (صَلَّى اللهُ عَلَيْهِ وَآلِه) امْرَأَةً مِنْ كِنْدَةَ بِنْتَ أَبِي الْجَوْنِ فَلَمَّا مَاتَ إِبْرَاهِيمُ بْنُ رَسُولِ اللهِ (صَلَّى اللهُ عَلَيْهِ وَآلِه) ابْنُ مَارِيَةَ الْقِبْطِيَّةِ قَالَتْ لَوْ كَانَ نَبِيّاً مَا مَاتَ ابْنُهُ فَأَلْحَقَهَا رَسُولُ اللهِ (صَلَّى اللهُ عَلَيْهِ وَآلِه) بِأَهْلِهَا قَبْلَ أَنْ يَدْخُلَ بِهَا فَلَمَّا قُبِضَ رَسُولُ اللهِ (صَلَّى اللهُ عَلَيْهِ وَآلِه) وَوُلِّيَ النَّاسَ أَبُو بَكْرٍ أَتَتْهُ الْعَامِرِيَّةُ وَالْكِنْدِيَّةُ وَقَدْ خُطِبَتَا فَاجْتَمَعَ أَبُو بَكْرٍ وَعُمَرُ فَقَالا لَهُمَا اخْتَارَا إِنْ شِئْتُمَا الْحِجَابَ وَإِنْ شِئْتُمَا الْبَاهَ فَاخْتَارَتَا الْبَاهَ فَتَزَوَّجَتَا فَجُذِمَ أَحَدُ الرَّجُلَيْنِ وَجُنَّ الآخَرُ. قَالَ عُمَرُ بْنُ أُذَيْنَةَ فَحَدَّثْتُ بِهَذَا الْحَدِيثِ زُرَارَةَ وَالْفُضَيْلَ فَرَوَيَا عَنْ أَبِي جَعْفَرٍ (عَلَيْهِ السَّلام) أَنَّهُ قَالَ مَا نَهَى اللهُ عَزَّ وَجَلَّ عَنْ شَيْ‏ءٍ إِلا وَقَدْ عُصِيَ فِيهِ حَتَّى لَقَدْ نَكَحُوا أَزْوَاجَ النَّبِيِّ (صَلَّى اللهُ عَلَيْهِ وَآلِه) مِنْ بَعْدِهِ وَذَكَرَ هَاتَيْنِ الْعَامِرِيَّةَ وَالْكِنْدِيَّةَ ثُمَّ قَالَ أَبُو جَعْفَرٍ (عَلَيْهِ السَّلام) لَوْ سَأَلْتَهُمْ عَنْ رَجُلٍ تَزَوَّجَ امْرَأَةً فَطَلَّقَهَا قَبْلَ أَنْ يَدْخُلَ بِهَا أَتَحِلُّ لابْنِهِ لَقَالُوا لا فَرَسُولُ اللهِ (صَلَّى اللهُ عَلَيْهِ وَآلِه) أَعْظَمُ حُرْمَةً مِنْ آبَائِهِمْ.

    3. Ali ibn Ibrahim has narrated from his father from ibn abu ‘Umayr from ‘Umar ibn ‘Udhaynah who has said the following: “Sa‘d ibn abu ‘Urwah narrated to me from al-Hassan al-Basriy that the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, married a woman from the tribe of banu ’Amir ibn Sa‘sa‘ah called Sana’ and she was the most beautiful among women of her time. When ‘A’ishah and Hafsah looked at her they said that she will dominate them before the Messenger of Allah because of her beauty. They said to her, ‘The Messenger of Allah does not show any interest in you.’ When she went to the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, he (the Messenger of Allah) took her in his hand and she said, ‘I seek refuge with Allah.’ The hand of the Messenger of Allah moved away from her and he divorced her and sent her to her family. The Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, married a woman from Kindah who was a daughter of abu al-Jawn. When Ibrahim, son of the Messenger of Allah from Maria the Coptic died, she said, ‘Had he been a prophet, his son would not die.’ The Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, sent her to her family before going to bed with her. When the Messenger of Allah passed away and abu Bakr took charge of the affairs of the people; al-‘Amiriyah and al-Kindah women who had proposed for marriage came to him. Abu Bakr and ‘Umar had a meeting and they said to the women, ‘You can choose the veil or sexual satisfaction.’ They chose sexual satisfaction and married but one of the men contracted leprosy and the other man became insane. ‘Umar ibn ‘Udhaynah has said, ‘I narrated this Hadith to Zurarah and al-Fudayl and they narrated it from abu Ja‘far, ‘Alayhi al-Salam, who has said, ‘Whatever Allah, most Majestic, most Glorious, prohibited He is disobeyed in it so much so that they even married the wives of the Holy Prophet, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, after him and he (the Imam) mentioned the two women, al-‘Amiriyah and al-Kindiyah. Abu Ja‘far, ‘Alayhi al-Salam, then said, ‘If you ask them about the case of a man who marries a woman then divorces her before going to bed with her if she is lawful for his son, they will say, ’No. It is not lawful.’ The Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, is greater than their fathers in matters of unlawfulness in such case.”’

    4- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ عَلِيِّ بْنِ الْحَكَمِ عَنْ مُوسَى بْنِ بَكْرٍ عَنْ زُرَارَةَ بْنِ أَعْيَنَ عَنْ أَبِي جَعْفَرٍ (عَلَيْهِ السَّلام) نَحْوَهُ وَقَالَ فِي حَدِيثِهِ وَلا هُمْ يَسْتَحِلُّونَ أَنْ يَتَزَوَّجُوا أُمَّهَاتِهِمْ إِنْ كَانُوا مُؤْمِنِينَ وَإِنَّ أَزْوَاجَ رَسُولِ اللهِ (صَلَّى اللهُ عَلَيْهِ وَآلِه) فِي الْحُرْمَةِ مِثْلُ أُمَّهَاتِهِمْ.

    4. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from Musa ibn Bakr from Zurarah ibn ‘A‘yan who has said the following: “Zurarah has narrated a Hadith similar to the previous Hadith from Abu Ja’far, ‘Alayhi al-Salam, and he (the Imam) has said, ’They do not consider it lawful to marry their mothers if they are believers. The wives of the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, in the matter of the above unlawfulness are like their mothers.’”

    1- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ جَمِيلِ بْنِ دَرَّاجٍ وَحَمَّادِ بْنِ عُثْمَانَ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ الأمُّ وَالابْنَةُ سَوَاءٌ إِذَا لَمْ يَدْخُلْ بِهَا يَعْنِي إِذَا تَزَوَّجَ الْمَرْأَةَ ثُمَّ طَلَّقَهَا قَبْلَ أَنْ يَدْخُلَ بِهَا فَإِنَّهُ إِنْ شَاءَ تَزَوَّجَ أُمَّهَا وَإِنْ شَاءَ تَزَوَّجَ ابْنَتَهَا.

    1. Ali ibn Ibrahim has narrated from his father from ibn abu ‘Umayr from Jamil ibn Darraj and Hammad ibn ‘Uthaman who has said the following: “Abu ‘ Abd Allah, ‘Alayhi al-Salam, has said, ‘A mother and daughter are the same if one has not gone to bed with her, that is, if one marries a woman then divorces her before going to bed with her, in such case it is permissible to marry her mother or her daughter.”

    2- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ عِيسَى عَنْ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ أَبِي نَصْرٍ قَالَ سَأَلْتُ أَبَا الْحَسَنِ (عَلَيْهِ السَّلام) عَنِ الرَّجُلِ يَتَزَوَّجُ الْمَرْأَةَ مُتْعَةً أَيَحِلُّ لَهُ أَنْ يَتَزَوَّجَ ابْنَتَهَا قَالَ لا.

    2. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad ibn ‘Isa from Ahmad ibn Muhammad from ibn abu Nasr who has said the following: “I once asked abu al-Hassan, ‘Alayhi al-Salam, about the case of a man who married a woman in manner of al-Mut‘ah; if it is permissible for him to marry her daughter. He (the Imam) said, ‘No, it is not permissible.’”

    3- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ عَلِيِّ بْنِ الْحَكَمِ عَنِ الْعَلاءِ بْنِ رَزِينٍ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَحَدِهِمَا (عَلَيْهِما السَّلام) قَالَ سَأَلْتُهُ عَنْ رَجُلٍ تَزَوَّجَ امْرَأَةً فَنَظَرَ إِلَى رَأْسِهَا وَإِلَى بَعْضِ جَسَدِهَا أَيَتَزَوَّجُ ابْنَتَهَا فَقَالَ لا إِذَا رَأَى مِنْهَا مَا يَحْرُمُ عَلَى غَيْرِهِ فَلَيْسَ لَهُ أَنْ يَتَزَوَّجُ ابْنَتَهَا.

    3. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from al-‘Ala’ ibn Razin from Muhammad ibn Muslim who has said the following: “I once asked one of the two Imam, (abu Ja’far or abu ‘Abd Allah), ‘Alayhim al-Salam, about the case of a man who married a woman and looks at her head and a few places of her body; if he could marry her daughter. He (the Imam) said, ‘No, he cannot do so when he has seen what is unlawful for people other than him to look at. It is not lawful for him to marry her daughter.’”

    4- أَبُو عَلِيٍّ الأشْعَرِيُّ عَنْ مُحَمَّدِ بْنِ عَبْدِ الْجَبَّارِ وَمُحَمَّدُ بْنُ إِسْمَاعِيلَ عَنِ الْفَضْلِ بْنِ شَاذَانَ عَنْ صَفْوَانَ بْنِ يَحْيَى عَنْ مَنْصُورِ بْنِ حَازِمٍ قَالَ كُنْتُ عِنْدَ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) فَأَتَاهُ رَجُلٌ فَسَأَلَهُ عَنْ رَجُلٍ تَزَوَّجَ امْرَأَةً فَمَاتَتْ قَبْلَ أَنْ يَدْخُلَ بِهَا أَيَتَزَوَّجُ بِأُمِّهَا فَقَالَ أَبُو عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَدْ فَعَلَهُ رَجُلٌ مِنَّا فَلَمْ نَرَ بِهِ بَأْساً فَقُلْتُ جُعِلْتُ فِدَاكَ مَا تَفْخَرُ الشِّيعَةُ إِلا بِقَضَاءِ عَلِيٍّ (عَلَيْهِ السَّلام) فِي هَذِهِ الشَّمْخِيَّةِ الَّتِي أَفْتَاهَا ابْنُ مَسْعُودٍ أَنَّهُ لا بَأْسَ بِذَلِكَ ثُمَّ أَتَى عَلِيّاً (عَلَيْهِ السَّلام) فَسَأَلَهُ فَقَالَ لَهُ عَلِيٌّ (عَلَيْهِ السَّلام) مِنْ أَيْنَ أَخَذْتَهَا فَقَالَ مِنْ قَوْلِ اللهِ عَزَّ وَجَلَّ وَرَبائِبُكُمُ اللاتِي فِي حُجُورِكُمْ مِنْ نِسائِكُمُ اللاتِي دَخَلْتُمْ بِهِنَّ فَإِنْ لَمْ تَكُونُوا دَخَلْتُمْ بِهِنَّ فَلا جُناحَ عَلَيْكُمْ فَقَالَ عَلِيٌّ (عَلَيْهِ السَّلام) إِنَّ هَذِهِ مُسْتَثْنَاةٌ وَهَذِهِ مُرْسَلَةٌ وَأُمَّهاتُ نِسائِكُمْ فَقَالَ أَبُو عَبْدِ اللهِ (عَلَيْهِ السَّلام) لِلرَّجُلِ أَمَا تَسْمَعُ مَا يَرْوِي هَذَا عَنْ عَلِيٍّ (عَلَيْهِ السَّلام) فَلَمَّا قُمْتُ نَدِمْتُ وَقُلْتُ أَيَّ شَيْ‏ءٍ صَنَعْتُ يَقُولُ هُوَ قَدْ فَعَلَهُ رَجُلٌ مِنَّا فَلَمْ نَرَ بِهِ بَأْساً وَأَقُولُ أَنَا قَضَى عَلِيٌّ (عَلَيْهِ السَّلام) فِيهَا فَلَقِيتُهُ بَعْدَ ذَلِكَ فَقُلْتُ جُعِلْتُ فِدَاكَ مَسْأَلَةُ الرَّجُلِ إِنَّمَا كَانَ الَّذِي قُلْتُ يَقُولُ كَانَ زَلَّةً مِنِّي فَمَا تَقُولُ فِيهَا فَقَالَ يَا شَيْخُ تُخْبِرُنِي أَنَّ عَلِيّاً (عَلَيْهِ السَّلام) قَضَى بِهَا وَتَسْأَلُنِي مَا تَقُولُ فِيهَا.

    4. Abu Ali al-Ash’ariy has narrated from Muhammad ibn ‘Abd al-Jabbar and Muhammad ibn ‘Isma’il has narrated from al-Fadl ibn Shadhan from Safwan ibn Yahya from Mansur ibn Hazim who has said the following: “Once I was with abu ‘Abd Allah, ‘Alayhi al-Salam, when a man came and asked about the case of a man who married a woman but she died before going to bed with her; if he could marry her mother. Abu ‘Abd Allah, ‘Alayhi al-Salam, said, ‘A man from us had done so, thus I do not see it as unlawful.’ I then said, ‘I pray to Allah to keep my soul in service for your cause, al-Shi’ah are only proud of the judgment of Ali, ‘Alayhi al-Salam, on the issue of al-Shamakhiyah about which ibn Mas‘ud had given a Fatwa that said, “It is not harmful”, then he went to Ali, ‘Alayhi al-Salam, and asked him (the Imam) and Ali, ‘Alayhi al-Salam, asked, “From what source did you take it?” He (ibn Mas‘ud) replied, “I took it from the words of Allah, most Majestic, most Glorious, ‘. . . and those who grow in your care from your women with whom you have gone to bed but if you have not gone to bed with them (their mother) then it is not harmful for you . . .’ (4:23)” Ali, ‘Alayhi al-Salam, said, “This (the case in this verse) is an exception (from woman married in general with or without sexual intercourse) and this one is free of such exceptions (that is she is divorced and there is no question about sexual intercourse) and ‘the mother of your women’ in the above verse.’” Abu ‘Abd Allah, ‘Alayhi al-Salam, said to the man, ‘Do you hear what this man is narrating from Ali, ‘Alayhi al-Salam .’ When I stood up I regretted and said to myself, ‘What did I do?’ He (the Imam) said, ‘A man from us has done so, thus I do not see it as harmful,’ and I say, ‘Ali, ‘Alayhi al-Salam, judged the issue.’ I then met him (the Imam) afterwards and said, ‘I pray to Allah to keep my soul in service for your cause, about the question of that man, my saying that “he says so and so” was a slip from me. What do you say about it?’ He (the Imam) said, ‘O Shaykh, when you narrate to me that Ali, ‘Alayhi al-Salam, judged the issue then why do you ask me about what I say on the case?”’ (One must consult fatwa about the above Hadith)

    5- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنِ ابْنِ مَحْبُوبٍ عَنْ خَالِدِ بْنِ جَرِيرٍ عَنْ أَبِي الرَّبِيعِ قَالَ سُئِلَ أَبُو عَبْدِ اللهِ (عَلَيْهِ السَّلام) عَنْ رَجُلٍ تَزَوَّجَ امْرَأَةً فَمَكَثَ أَيَّاماً مَعَهَا لا يَسْتَطِيعُهَا غَيْرَ أَنَّهُ قَدْ رَأَى مِنْهَا مَا يَحْرُمُ عَلَى غَيْرِهِ ثُمَّ يُطَلِّقُهَا أَيَصْلُحُ لَهُ أَنْ يَتَزَوَّجَ ابْنَتَهَا فَقَالَ أَيَصْلُحُ لَهُ وَقَدْ رَأَى مِنْ أُمِّهَا مَا قَدْ رَأَى‏.

    5. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ibn Mahbub from Khalid ibn Jarir from abu al-Rabi‘ who has said the following: “About the case of a man who marries a woman and lives with her for many days, unable to do anything except that he has seen from her what is unlawful for others to see; then he divorces her; if he can marry her daughter. He (the Imam) said, ’How can it be proper for him when he has seen of her mother what he has seen?’”

    1- مُحَمَّدُ بْنُ يَحْيَى عَنْ مُحَمَّدِ بْنِ الْحُسَيْنِ عَنْ عُثْمَانَ بْنِ عِيسَى عَنْ بَعْضِ أَصْحَابِنَا عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) أَنَّهُ قَالَ إِيَّاكُمْ وَذَوَاتِ الأزْوَاجِ الْمُطَلَّقَاتِ عَلَى غَيْرِ السُّنَّةِ قَالَ قُلْتُ لَهُ فَرَجُلٌ طَلَّقَ امْرَأَتَهُ مِنْ هَؤُلاءِ وَلِي بِهَا حَاجَةٌ قَالَ فَتَلْقَاهُ بَعْدَ مَا طَلَّقَهَا وَانْقَضَتْ عِدَّتُهَا عِنْدَ صَاحِبِهَا فَتَقُولُ لَهُ طَلَّقْتَ فُلانَةَ فَإِذَا قَالَ نَعَمْ فَقَدْ صَارَ تَطْلِيقَةً عَلَى طُهْرٍ فَدَعْهَا مِنْ حِينَ طَلَّقَهَا تِلْكَ التَّطْلِيقَةَ حَتَّى تَنْقَضِيَ عِدَّتُهَا ثُمَّ تَزَوَّجْهَا فَقَدْ صَارَتْ تَطْلِيقَةً بَائِنَةً.

    1. Muhammad ibn Yahya has narrated from Muhammad ibn al-Husayn from ‘Uthman ibn ‘Isa from certain persons of our people who have said the following: “Abu ‘ Abd Allah, ‘Alayhi al-Salam, has said, ‘You must remain on your guard in the case of married women who are divorced against the Sunnah.’ I asked him (the Imam) that a man has divorced his wife and I am interested. He (the Imam) said, ‘Meet him after he divorces her and waiting period is complete with him then ask him, ‘Have you divorced so and so?’ If he said, ‘Yes, I have divorced her’, this is one divorce during a menses free period. From the time he has divorced her until waiting period is complete then you can marry and divorce has made them complete strangers to each other.’”

    2- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ عِيسَى عَنِ الْحُسَيْنِ بْنِ سَعِيدٍ عَنِ النَّضْرِ بْنِ سُوَيْدٍ عَنْ مُحَمَّدِ بْنِ أَبِي حَمْزَةَ عَنْ شُعَيْبٍ الْحَدَّادِ قَالَ قُلْتُ لأبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) رَجُلٌ مِنْ مَوَالِيكَ يُقْرِئُكَ السَّلامَ وَقَدْ أَرَادَ أَنْ يَتَزَوَّجَ امْرَأَةً قَدْ وَافَقَتْهُ وَأَعْجَبَهُ بَعْضُ شَأْنِهَا وَقَدْ كَانَ لَهَا زَوْجٌ فَطَلَّقَهَا ثَلاثاً عَلَى غَيْرِ السُّنَّةِ وَقَدْ كَرِهَ أَنْ يُقْدِمَ عَلَى تَزْوِيجِهَا حَتَّى يَسْتَأْمِرَكَ فَتَكُونَ أَنْتَ تَأْمُرُهُ فَقَالَ أَبُو عَبْدِ اللهِ (عَلَيْهِ السَّلام) هُوَ الْفَرْجُ وَأَمْرُ الْفَرْجِ شَدِيدٌ وَمِنْهُ يَكُونُ الْوَلَدُ وَنَحْنُ نَحْتَاطُ فَلا يَتَزَوَّجْهَا.

    2. A number of our people have narrated from Ahmad ibn Muhammad ibn ‘Isa from al-Husayn ibn Sa‘id from al-Nadr ibn Suwayd from Muhammad ibn abu Hamzah from Shu’ayb al-Hadad who has said the following: “I once said to abu ‘Abd Allah, ‘Alayhi al-Salam, ‘One of your followers offers greetings of peace to you and he wants to marry a woman who has agreed and he likes her due to certain matters about her and she has a husband who has divorced her three times on non-Sunnah basis. He dislikes marrying her without your instruction so you command him to do so. Abu ‘Abd Allah, ‘Alayhi al-Salam, said, ‘It is an issue of marriage and the matter of marriage is severe because from marriage are children and we maintain precaution, so he must not marry her.’”

    3- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ حَفْصِ بْنِ الْبَخْتَرِيِّ عَنْ إِسْحَاقَ بْنِ عَمَّارٍ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) فِي رَجُلٍ طَلَّقَ امْرَأَتَهُ ثَلاثاً فَأَرَادَ رَجُلٌ أَنْ يَتَزَوَّجَهَا كَيْفَ يَصْنَعُ قَالَ يَدَعُهَا حَتَّى تَحِيضَ وَتَطْهُرَ ثُمَّ يَأْتِيهِ وَمَعَهُ رَجُلانِ شَاهِدَانِ فَيَقُولُ أَطَلَّقْتَ فُلانَةَ فَإِذَا قَالَ نَعَمْ تَرَكَهَا ثَلاثَةَ أَشْهُرٍ ثُمَّ خَطَبَهَا إِلَى نَفْسِهَا.

    3. Ali ibn Ibrahim has narrated from his father from ibn abu ‘Umayr from Hafs ibn al-Bakhtariy from Ishaq ibn ‘Ammar who has said the following: “About the case of a man who divorces his wife three times and then another man wants to marry her and about what he must do, abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘He must wait until she experiences one cycle of menses; then he must go to the man who has divorced her and ask him in the presence of two people, ‘Have you divorced so and so?’ If he said, ‘Yes, I have divorced her, then he must leave her alone for three months, then propose to her for marriage.’”

    4. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from Musa ibn Bakr from Ali ibn Hanzalah who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘Beware of the case of a woman divorced three times in one meeting; they are married women.”

    1- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ عِيسَى عَنِ الْحَسَنِ بْنِ عَلِيِّ بْنِ فَضَّالٍ عَنِ ابْنِ بُكَيْرٍ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَبِي جَعْفَرٍ (عَلَيْهِ السَّلام) قَالَ لا تُزَوَّجُ ابْنَةُ الأخِ وَلا ابْنَةُ الأخْتِ عَلَى الْعَمَّةِ وَلا عَلَى الْخَالَةِ إِلا بِإِذْنِهِمَا وَتُزَوَّجُ الْعَمَّةُ وَالْخَالَةُ عَلَى ابْنَةِ الأخِ وَابْنَةِ الأخْتِ بِغَيْرِ إِذْنِهِمَا.

    1. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad ibn ‘Isa from al-Hassan ibn Ali ibn Faddal from ibn Bukayr from Muhammad ibn Muslim who has said the following: “Abu Ja‘far, ‘Alayhi al-Salam, has said, ‘You must not marry a daughter of a brother or daughter of a sister as a second wife, the first being her paternal or maternal aunt without their permission and you must not marry a paternal or maternal aunt as a second wife, the first being a daughter of her brother or a daughter of her sister, without their permission.’”

    2- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ عَنِ الْحَسَنِ بْنِ مَحْبُوبٍ عَنْ عَلِيِّ بْنِ رِئَابٍ عَنْ أَبِي عُبَيْدَةَ الْحَذَّاءِ قَالَ سَمِعْتُ أَبَا جَعْفَرٍ (عَلَيْهِ السَّلام) قَالَ لا تُنْكَحُ الْمَرْأَةُ عَلَى عَمَّتِهَا وَلا خَالَتِهَا إِلا بِإِذْنِ الْعَمَّةِ وَالْخَالَةِ.

    2. A number of our people have narrated from Sahl ibn Ziyad from al-Hassan ibn Mahbub from ibn Ri’ab from abu ‘Ubaydah al- Hadhdha’ who has said the following: “I once heard abu Ja‘far, ‘Alayhi al-Salam, saying, ‘You must not marry a woman as a second wife, the first being her paternal or maternal aunt, without her permission.’”

    1- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنْ حَمَّادِ بْنِ عِيسَى عَنْ حَرِيزٍ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَحَدِهِمَا (عَلَيْهِما السَّلام) قَالَ سَأَلْتُهُ عَنْ رَجُلٍ طَلَّقَ امْرَأَتَهُ ثَلاثاً ثُمَّ تَمَتَّعَ فِيهَا رَجُلٌ آخَرُ هَلْ تَحِلُّ لِلأوَّلِ قَالَ لا.

    1. Ali ibn Ibrahim has narrated from his father from Hammad ibn ‘Isa from Hariz from Muhammad ibn Muslim who has said the following: “I once asked one of the two Imam, (abu Ja’far or abu ‘Abd Allah), ‘Alayhim al-Salam, about the case of a man who divorced his wife three times; then another man formed Mut‘ah with her if thereafter she can become lawful for him. He (the Imam) said, ‘No, it ( Mut‘ah ) is not enough.’”

    2- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ عَنْ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ أَبِي نَصْرٍ عَنْ عَبْدِ الْكَرِيمِ عَنِ الْحَسَنِ الصَّيْقَلِ قَالَ سَأَلْتُ أَبَا عَبْدِ اللهِ (عَلَيْهِ السَّلام) عَنْ رَجُلٍ طَلَّقَ امْرَأَتَهُ طَلاقاً لا تَحِلُّ لَهُ حَتَّى تَنْكِحَ زَوْجاً غَيْرَهُ وَتَزَوَّجَهَا رَجُلٌ مُتْعَةً أَيَحِلُّ لَهُ أَنْ يَنْكِحَهَا قَالَ لا حَتَّى تَدْخُلَ فِي مِثْلِ مَا خَرَجَتْ مِنْهُ.

    2. A number of our people have narrated from Sahl ibn Ziyad from Ahmad ibn Muhammad from ibn abu Nasr from ‘Abd al-Karim from al-Hassan al-Sayqal who has said the following: “This is concerning my question before abu ‘Abd Allah, ‘Alayhi al-Salam, about the case of a man who divorces his wife as such that thereafter he cannot marry her without her marriage with another man but a man marries her in the manner of Mut‘ah; if thereafter he can marry her. He (the Imam) said, ‘No, until she enters into what is similar to what from which she has come out.’”
