    2- مُحَمَّدُ بْنُ يَحْيَى عَنْ مُحَمَّدِ بْنِ أَحْمَدَ عَنْ مُحَمَّدِ بْنِ عِيسَى عَنْ أَبِي مُحَمَّدٍ الأنْصَارِيِّ عَنْ عَمْرِو بْنِ شِمْرٍ عَنْ جَابِرِ بْنِ يَزِيدَ قَالَ سَأَلْتُ أَبَا جَعْفَرٍ (عَلَيْهِ السَّلام) عَنِ الْقَابِلَةِ أَيَحِلُّ لِلْمَوْلُودِ أَنْ يَنْكِحَهَا فَقَالَ لا وَلا ابْنَتَهَا هِيَ بَعْضُ أُمَّهَاتِهِ. وَفِي رِوَايَةِ مُعَاوِيَةَ بْنِ عَمَّارٍ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ قَالَ إِنْ قَبِلَتْ وَمَرَّتْ فَالْقَوَابِلُ أَكْثَرُ مِنْ ذَلِكَ وَإِنْ قَبِلَتْ وَرَبَّتْ حَرُمَتْ عَلَيْهِ.

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad ibn ‘Isa from abu Muhammad al-Ansariy from “Amr ibn Shamir from Jabir ibn Yazid who has said the following: “This is concerning my question before abu Ja‘far, ‘Alayhi al-Salam, about al-Qabilah (special nurse who helps one’s mother during her giving birth and thereafter); if the child can marry her. He (the Imam) said, ‘No, not her daughter also, because she is one of his mothers.’ Mu‘awiyah ibn ‘Ammar has narrated the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘If she just helps to give birth and moves on, then such nurses are many; but if she helps during birth, and brings him up, then she is unlawful for marriage.’”

    3- حُمَيْدُ بْنُ زِيَادٍ عَنْ عَبْدِ اللهِ بْنِ أَحْمَدَ عَنْ عَلِيِّ بْنِ الْحَسَنِ عَنْ مُحَمَّدِ بْنِ زِيَادِ بْنِ عِيسَى بَيَّاعِ السَّابِرِيِّ عَنْ أَبَانِ بْنِ عُثْمَانَ عَنْ إِبْرَاهِيمَ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ إِذَا اسْتَقْبَلَ الصَّبِيُّ الْقَابِلَةَ بِوَجْهِهِ حَرُمَتْ عَلَيْهِ وَحَرُمَ عَلَيْهِ وَلَدُهَا.

    3. Humayd ibn Ziyad has narrated from ‘Abd Allah ibn Ahmad from Ali ibn al-Hassan from Muhammad ibn Ziyad ibn ‘Isa Bayya’ al- Sabiriy from Aban ibn ‘Uthman from Ibrahim who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘If the child feels compassion toward al-Qabilah (special nurse who helps one’s mother during her giving birth and thereafter) she becomes unlawful to him for marriage as well as her children.’”

    1- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ وَعَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ جَمِيعاً عَنِ ابْنِ أَبِي نَجْرَانَ عَنْ عَاصِمِ بْنِ حُمَيْدٍ عَنْ أَبِي بَصِيرٍ قَالَ سَأَلْتُ أَبَا جَعْفَرٍ (عَلَيْهِ السَّلام) عَنِ الْمُتْعَةِ فَقَالَ نَزَلَتْ فِي الْقُرْآنِ فَمَا اسْتَمْتَعْتُمْ بِهِ مِنْهُنَّ فَ‏آتُوهُنَّ أُجُورَهُنَّ فَرِيضَةً وَلا جُناحَ عَلَيْكُمْ فِيما تَراضَيْتُمْ بِهِ مِنْ بَعْدِ الْفَرِيضَةِ.

    1. A number of our people have narrated from Sahl ibn Ziyad and Ali ibn Ibrahim has narrated from his father from all from ibn abu Najran from ‘Asem ibn Hamid from abu Basir who has said the following: “In response to my question before abu Ja’far, ‘Alayhi al-Salam, about al-Mut‘ah (advantageous marriage), he (the Imam) said, ‘It is mentioned in al-Quran, “If you marry them for al-Mut‘ah (advantageous marriage) you must pay their dowries. There is no harm if you reach an understanding among yourselves about mahr (the dowry). Allah is All-knowing and All-wise.’”” (4:24)

    2- مُحَمَّدُ بْنُ إِسْمَاعِيلَ عَنِ الْفَضْلِ بْنِ شَاذَانَ عَنْ صَفْوَانَ بْنِ يَحْيَى عَنِ ابْنِ مُسْكَانَ عَنْ عَبْدِ اللهِ بْنِ سُلَيْمَانَ قَالَ سَمِعْتُ أَبَا جَعْفَرٍ (عَلَيْهِ السَّلام) يَقُولُ كَانَ عَلِيٌّ (عَلَيْهِ السَّلام) يَقُولُ لَوْ لا مَا سَبَقَنِي بِهِ بَنِي الْخَطَّابِ مَا زَنَى إِلا شَقِيٌّ.

    2. Muhammad ibn ‘Isma’il has narrated from al-Fadl ibn Shadhan from Safwan ibn Yahya from ibn Muskan from ‘Abd Allah ibn Sulayman who has said the following: “I once heard abu Ja‘far, ‘Alayhi al-Salam, saying that Ali, ‘Alayhi al-Salam, would say, ‘Had banu al- Khattab not prohibited al-Mut‘ah (advantageous marriage) before (the beginning of my administration) no one would commit fornication except the wicked ones.’”

    3- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَمَّنْ ذَكَرَهُ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ إِنَّمَا نَزَلَتْ فَمَا اسْتَمْتَعْتُمْ بِهِ مِنْهُنَّ إِلَى أَجَلٍ مُسَمًّى فَ‏آتُوهُنَّ أُجُورَهُنَّ فَرِيضَةً.

    3. Ali ibn Ibrahim has narrated from his father from ibn abu ‘Umayr from those whom he has mentioned who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘It was revealed as “If you marry them [for an appointed time] for al-Mut‘ah (advantageous marriage) you must pay their dowries.” (4:24)’”

    4- عَلِيٌّ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ عُمَرَ بْنِ أُذَيْنَةَ عَنْ زُرَارَةَ قَالَ جَاءَ عَبْدُ اللهِ بْنُ عُمَيْرٍ اللَّيْثِيُّ إِلَى أَبِي جَعْفَرٍ (عَلَيْهِ السَّلام) فَقَالَ لَهُ مَا تَقُولُ فِي مُتْعَةِ النِّسَاءِ فَقَالَ أَحَلَّهَا اللهُ فِي كِتَابِهِ وَعَلَى لِسَانِ نَبِيِّهِ (صَلَّى اللهُ عَلَيْهِ وَآلِه) فَهِيَ حَلالٌ إِلَى يَوْمِ الْقِيَامَةِ فَقَالَ يَا أَبَا جَعْفَرٍ مِثْلُكَ يَقُولُ هَذَا وَقَدْ حَرَّمَهَا عُمَرُ وَنَهَى عَنْهَا فَقَالَ وَإِنْ كَانَ فَعَلَ قَالَ إِنِّي أُعِيذُكَ بِاللهِ مِنْ ذَلِكَ أَنْ تُحِلَّ شَيْئاً حَرَّمَهُ عُمَرُ قَالَ فَقَالَ لَهُ فَأَنْتَ عَلَى قَوْلِ صَاحِبِكَ وَأَنَا عَلَى قَوْلِ رَسُولِ اللهِ (صَلَّى اللهُ عَلَيْهِ وَآلِه) فَهَلُمَّ أُلاعِنْكَ أَنَّ الْقَوْلَ مَا قَالَ رَسُولُ اللهِ (صَلَّى اللهُ عَلَيْهِ وَآلِه) وَأَنَّ الْبَاطِلَ مَا قَالَ صَاحِبُكَ قَالَ فَأَقْبَلَ عَبْدُ اللهِ بْنُ عُمَيْرٍ فَقَالَ يَسُرُّكَ أَنَّ نِسَاءَكَ وَبَنَاتِكَ وَأَخَوَاتِكَ وَبَنَاتِ عَمِّكَ يَفْعَلْنَ قَالَ فَأَعْرَضَ عَنْهُ أَبُو جَعْفَرٍ (عَلَيْهِ السَّلام) حِينَ ذَكَرَ نِسَاءَهُ وَبَنَاتِ عَمِّهِ.

    4. Ali ibn Ibrahim has narrated from his father from ibn abu ‘Umayr from ‘Umar ibn ‘Udhaynah from Zurarah who has said the following: “Once ‘Abd Allah ibn ‘Umayr al-Laythiy came to abu Ja‘far, ‘Alayhi al-Salam, and asked, ‘What do you say about al-Mut‘ah (advantageous marriage) of women?’ He (the Imam) said, ‘Allah has made it lawful in His book by the tongue of His Holy prophet, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, thus it will remain lawful up to the Day of Judgment.’ He then said, ‘O abu Ja’far, how can someone like you say this, when ‘Umar made it unlawful and prohibited it?’ He (the Imam) said, ‘Even if he has done so.’ He said, ‘I ask Allah to protect you against a thing that ‘Umar has made unlawful.’ He (the narrator) has said that he (the Imam) then said, ‘So you can stand by the words of your friend but I stand by the words of the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, and I am prepared for al-Mula‘inah (ask Allah to condemn the party on the side of falsehood) that the word is what the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, has said; and that falsehood is what your friend has said.’ He (the narrator) has said that ‘Abd Allah ibn ‘Umayr then said, ‘Will it make you happy that your women, daughters, sisters, daughters of your aunts do?’ He (the narrator) has said that abu Ja‘far, ‘Alayhi al-Salam, when he mentioned his women and daughters of his aunts turned away from him.’”

    5- مُحَمَّدُ بْنُ يَحْيَى عَنْ عَبْدِ اللهِ بْنِ مُحَمَّدٍ عَنْ عَلِيِّ بْنِ الْحَكَمِ عَنْ أَبَانِ بْنِ عُثْمَانَ عَنْ أَبِي مَرْيَمَ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ الْمُتْعَةُ نَزَلَ بِهَا الْقُرْآنُ وَجَرَتْ بِهَا السُّنَّةُ مِنْ رَسُولِ اللهِ (صَلَّى اللهُ عَلَيْهِ وَآلِه).

    5. Muhammad ibn Yahya has narrated from ‘Abd Allah ibn Muhammad from Ali ibn al-Hakam from Aban ibn ‘Uthman from abu Maryam who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘Al-Mut‘ah (advantageous marriage) is mentioned in al- Quran and the Sunnah of the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, has followed it.’”

    6- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ عَلِيِّ بْنِ الْحَسَنِ بْنِ رِبَاطٍ عَنْ حَرِيزٍ عَنْ عَبْدِ الرَّحْمَنِ بْنِ أَبِي عَبْدِ اللهِ قَالَ سَمِعْتُ أَبَا حَنِيفَةَ يَسْأَلُ أَبَا عَبْدِ اللهِ (عَلَيْهِ السَّلام) عَنِ الْمُتْعَةِ فَقَالَ أَيَّ الْمُتْعَتَيْنِ تَسْأَلُ قَالَ سَأَلْتُكَ عَنْ مُتْعَةِ الْحَجِّ فَأَنْبِئْنِي عَنْ مُتْعَةِ النِّسَاءِ أَحَقٌّ هِيَ فَقَالَ سُبْحَانَ اللهِ أَمَا قَرَأْتَ كِتَابَ اللهِ عَزَّ وَجَلَّ فَمَا اسْتَمْتَعْتُمْ بِهِ مِنْهُنَّ فَ‏آتُوهُنَّ أُجُورَهُنَّ فَرِيضَةً فَقَالَ أَبُو حَنِيفَةَ وَاللهِ فَكَأَنَّهَا آيَةٌ لَمْ أَقْرَأْهَا قَطُّ.

    6. Ali ibn Ibrahim has narrated from his father from ibn abu ‘Umayr from Afi ibn af-Hassan ibn Ribat from Hariz from ‘ Abd af-Rahman ibn abu ‘Abd Allah who has said the following: “I heard abu Hanifah ask abu ‘Abd Allah, ‘Alayhi al-Salam, about al-Mut‘ah (advantageous matters). He (the Imam) asked, ‘Are you asking about the two al-Mut‘ah (advantageous matters)? 5 He said, ‘I asked you about al-Mut‘ah (advantageous matters of al-Hajj) and you inform me about al-Mut‘ah (advantageous marriage) is it true?’ He (the Imam) said, ‘Allah is free of all defects, have you not read the book of Allah, most Majestic, most Glorious, “If you marry them for al-Mut‘ah (advantageous marriage) you must pay their dowries. . . .”’ (4:24). Abu Hanifah said, ‘By Allah, it is as if I have never read this verse. 5 ”

    7- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ مَحْبُوبٍ عَنْ عَلِيٍّ السَّائِيِّ قَالَ قُلْتُ لأبِي الْحَسَنِ (عَلَيْهِ السَّلام) جُعِلْتُ فِدَاكَ إِنِّي كُنْتُ أَتَزَوَّجُ الْمُتْعَةَ فَكَرِهْتُهَا وَتَشَأَّمْتُ بِهَا فَأَعْطَيْتُ اللهَ عَهْداً بَيْنَ الرُّكْنِ وَالْمَقَامِ وَجَعَلْتُ عَلَيَّ فِي ذَلِكَ نَذْراً وَصِيَاماً أَلا أَتَزَوَّجَهَا ثُمَّ إِنَّ ذَلِكَ شَقَّ عَلَيَّ وَنَدِمْتُ عَلَى يَمِينِي وَلَمْ يَكُنْ بِيَدِي مِنَ الْقُوَّةِ مَا أَتَزَوَّجُ فِي الْعَلانِيَةِ قَالَ فَقَالَ لِي عَاهَدْتَ اللهَ أَنْ لا تُطِيعَهُ وَاللهِ لَئِنْ لَمْ تُطِعْهُ لَتَعْصِيَنَّهُ.

    7. Ali ibn Ibrahim has narrated from his father from ibn Mahbub from al-Sa’iy who has said the following: “I once said to abu al-Hassan, ‘Alayhi al-Salam, ‘I pray to Allah to keep my soul in service for your cause, I would marry in the manner of al-Mut‘ah (advantageous marriage), I then disliked it and had bad omens about it; then I promised before Allah between the corner of al-Ka 5 bah and the Station of Ibrahim, ‘Alayhi al-Salam, kept a vow upon myself and fasting not to do such marriage again. It became difficult for me, I regretted because of my swearing and I was not able to marry publicly. He (the Imam) said, ‘You promised Allah not to obey Him. By Allah, if you do not obey Him you sin against Him. 555

    8- عَلِيٌّ رَفَعَهُ قَالَ سَأَلَ أَبُو حَنِيفَةَ أَبَا جَعْفَرٍ مُحَمَّدَ بْنَ النُّعْمَانِ صَاحِبَ الطَّاقِ فَقَالَ لَهُ يَا أَبَا جَعْفَرٍ مَا تَقُولُ فِي الْمُتْعَةِ أَتَزْعُمُ أَنَّهَا حَلالٌ قَالَ نَعَمْ قَالَ فَمَا يَمْنَعُكَ أَنْ تَأْمُرَ نِسَاءَكَ أَنْ يُسْتَمْتَعْنَ وَيَكْتَسِبْنَ عَلَيْكَ فَقَالَ لَهُ أَبُو جَعْفَرٍ لَيْسَ كُلُّ الصِّنَاعَاتِ يُرْغَبُ فِيهَا وَإِنْ كَانَتْ حَلالا وَلِلنَّاسِ أَقْدَارٌ وَمَرَاتِبُ يَرْفَعُونَ أَقْدَارَهُمْ وَلَكِنْ مَا تَقُولُ يَا أَبَا حَنِيفَةَ فِي النَّبِيذِ أَتَزْعُمُ أَنَّهُ حَلالٌ فَقَالَ نَعَمْ قَالَ فَمَا يَمْنَعُكَ أَنْ تُقْعِدَ نِسَاءَكَ فِي الْحَوَانِيتِ نَبَّاذَاتٍ فَيَكْتَسِبْنَ عَلَيْكَ فَقَالَ أَبُو حَنِيفَةَ وَاحِدَةٌ بِوَاحِدَةٍ وَسَهْمُكَ أَنْفَذُ ثُمَّ قَالَ لَهُ يَا أَبَا جَعْفَرٍ إِنَّ الآيَةَ الَّتِي فِي سَأَلَ سَائِلٌ تَنْطِقُ بِتَحْرِيمِ الْمُتْعَةِ وَالرِّوَايَةَ عَنِ النَّبِيِّ (صَلَّى اللهُ عَلَيْهِ وَآلِه) قَدْ جَاءَتْ بِنَسْخِهَا فَقَالَ لَهُ أَبُو جَعْفَرٍ يَا أَبَا حَنِيفَةَ إِنَّ سُورَةَ سَأَلَ سَائِلٌ مَكِّيَّةٌ وَآيَةُ الْمُتْعَةِ مَدَنِيَّةٌ وَرِوَايَتَكَ شَاذَّةٌ رَدِيَّةٌ فَقَالَ لَهُ أَبُو حَنِيفَةَ وَآيَةُ الْمِيرَاثِ أَيْضاً تَنْطِقُ بِنَسْخِ الْمُتْعَةِ فَقَالَ أَبُو جَعْفَرٍ قَدْ ثَبَتَ النِّكَاحُ بِغَيْرِ مِيرَاثٍ قَالَ أَبُو حَنِيفَةَ مِنْ أَيْنَ قُلْتَ ذَاكَ فَقَالَ أَبُو جَعْفَرٍ لَوْ أَنَّ رَجُلا مِنَ الْمُسْلِمِينَ تَزَوَّجَ امْرَأَةً مِنْ أَهْلِ الْكِتَابِ ثُمَّ تُوُفِّيَ عَنْهَا مَا تَقُولُ فِيهَا قَالَ لا تَرِثُ مِنْهُ قَالَ فَقَدْ ثَبَتَ النِّكَاحُ بِغَيْرِ مِيرَاثٍ ثُمَّ افْتَرَقَا.

    8. Ali has narrated from in a marfu’ manner saying: “Abu Hanifah once asked abu Ja‘far, Muhammad ibn al-Nu 5 man Sahib al-Taq saying, ‘O abu Ja‘far, what do you say about al-Mut‘ah (advantageous marriage)? Do you think it is lawful? 5 He replied, ‘Yes, it is lawful. 5 He then said, ‘Why then do you not ask your women to go for al-Mut‘ah (advantageous marriage) and earn for you? 5 Abu Ja’far said, ‘All kinds of skills are not desirable even if they are lawful, because people have their values and positions which raise their values. However, what do you say O abu Hanifah, about al-Nabidh (wine from dates)? Do you think it is lawful? 5 He replied, ‘Yes, it is lawful. 5 He then said, ‘What prevents you from making your women sit in shops as al-Nabidh sellers to sell al-Nabidh to earn for you? 5 Abu Hanifah said, ‘This is one for one and your share is more effective. 5 He then said, ‘O abu Ja‘far, the verse in which there is “one asking a question asked” (Chapter 70) speaks of unlawfulness of al-Mut‘ah (advantageous marriage) and Hadith from the Holy Prophet, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, has come to cancel it. 5 Abu Ja’far said, ‘O abu Hanifah, the chapter “one asking a question asked” was revealed in Makkah and the verse that speaks of al-Mut‘ah (advantageous marriage) was revealed in al-Madinah and Hadith you spoke of is atypical and refuted. 5 Abu Hanifah then said, ‘The verse about inheritance also speaks of cancellation of al-Mut‘ah (advantageous marriage). 5 Abu Ja‘far, said, ‘Proof of lawfulness of marriage is without inheritance. 5 Abu Hanifah said, ‘On what basis you say so? 5 Abu Ja‘far, asked, ‘If a Muslim marries a woman from the people of the book then he dies what do you say about her? 5 He said, ‘She will not inherit him. 5 Abu Ja‘far, said, ‘So marriage is proved without inheritance. They then departed each other. 5 ” (Because of marriage spouses inherit each other. In Mut‘ah inheritance is not applicable thus Mut‘ah is not a marriage, according to the argument of abu Hanifah, if inheritance between the spouses is not applicable it is not a marriage. Abu Ja’far, proved one case where there is marriage but inheritance is not applicable).

    1- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ عُمَرَ بْنِ أُذَيْنَةَ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ قُلْتُ كَمْ تَحِلُّ مِنَ الْمُتْعَةِ قَالَ فَقَالَ هُنَّ بِمَنْزِلَةِ الإمَاءِ.

    1. Ali ibn Ibrahim has narrated from his father from ibn abu ‘Umayr from ‘Umar ibn ‘Udhaynah who has said the following: “This is concerning my question before abu ‘ Abd Allah, ‘Alayhi al-Salam, about how many are lawful for al-Mut‘ah (advantageous marriage). He (the Imam) said, ‘Their case is similar to slave-girls.’”

    2- الْحُسَيْنُ بْنُ مُحَمَّدٍ عَنْ أَحْمَدَ بْنِ إِسْحَاقَ الأشْعَرِيِّ عَنْ بَكْرِ بْنِ مُحَمَّدٍ الأزْدِيِّ قَالَ سَأَلْتُ أَبَا الْحَسَنِ (عَلَيْهِ السَّلام) عَنِ الْمُتْعَةِ أَهِيَ مِنَ الأرْبَعِ فَقَالَ لا.

AI-Husayn from Muhammad has narrated from Ahmad ibn Ishaq al-Ash’ariy from Bakr ibn Muhammad af-Azdiy who has said the following: “In response to my question before abu ‘Abd Allah, ‘Alayhi al-Salam, about al-Mut‘ah (advantageous marriage) if it is one of the four, he (the Imam) said, ‘No, it is not one of the four.’”

    6- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ عُمَرَ بْنِ أُذَيْنَةَ عَنْ إِسْمَاعِيلَ بْنِ الْفَضْلِ الْهَاشِمِيِّ قَالَ سَأَلْتُ أَبَا عَبْدِ اللهِ (عَلَيْهِ السَّلام) عَنِ الْمُتْعَةِ فَقَالَ الْقَ عَبْدَ الْمَلِكِ بْنَ جُرَيْجٍ فَسَلْهُ عَنْهَا فَإِنَّ عِنْدَهُ مِنْهَا عِلْماً فَلَقِيتُهُ فَأَمْلَى عَلَيَّ مِنْهَا شَيْئاً كَثِيراً فِي اسْتِحْلالِهَا فَكَانَ فِيمَا رَوَى لِيَ ابْنُ جُرَيْجٍ قَالَ لَيْسَ فِيهَا وَقْتٌ وَلا عَدَدٌ إِنَّمَا هِيَ بِمَنْزِلَةِ الإمَاءِ يَتَزَوَّجُ مِنْهُنَّ كَمْ شَاءَ وَصَاحِبُ الأرْبَعِ نِسْوَةٍ يَتَزَوَّجُ مِنْهُنَّ مَا شَاءَ بِغَيْرِ وَلِيٍّ وَلا شُهُودٍ فَإِذَا انْقَضَى الأجَلُ بَانَتْ مِنْهُ بِغَيْرِ طَلاقٍ وَيُعْطِيهَا الشَّيْ‏ءَ الْيَسِيرَ وَعِدَّتُهَا حَيْضَتَانِ وَإِنْ كَانَتْ لا تَحِيضُ فَخَمْسَةٌ وَأَرْبَعُونَ يَوْماً فَأَتَيْتُ بِالْكِتَابِ أَبَا عَبْدِ اللهِ (عَلَيْهِ السَّلام) فَعَرَضْتُ عَلَيْهِ فَقَالَ صَدَقَ وَأَقَرَّ بِهِ قَالَ ابْنُ أُذَيْنَةَ وَكَانَ زُرَارَةُ بْنُ أَعْيَنَ يَقُولُ هَذَا وَيَحْلِفُ أَنَّهُ الْحَقُّ إِلا أَنَّهُ كَانَ يَقُولُ إِنْ كَانَتْ تَحِيضُ فَحَيْضَةٌ وَإِنْ كَانَتْ لا تَحِيضُ فَشَهْرٌ وَنِصْفٌ.

    6. Ali ibn Ibrahim has narrated from his father from ibn abu ‘Umayr from ‘Umar ibn ‘Udhaynah from ‘Isma’il ibn al-Fadl al-Hashimiy who has said the following: “This is concerning my question before abu ‘Abd Allah, ‘Alayhi al-Salam, about al-Mut‘ah (advantageous marriage). He (the Imam) said, ‘Meet ‘Abd al-Malik ibn Jurayh and ask him about it; he has information about it.’ I met him and he dictated a great deal of issues about its lawfulness. Among the matters that ibn Jurayh narrated to me was that he said, ‘There is no particular time limit for it or a particular number. The case is similar to that of the slave-girls. One may marry as many as he wishes and one with four wives can marry in this manner, as many as he wishes, without the presence of guardian or witness. When the time expires she becomes a stranger to him without divorce and he may give her something very little. Her waiting period is two cycles of menses but if she does not experience Hayd (menses) her waiting period is forty five days.’ I brought the book to abu ‘Abd Allah, ‘Alayhi al-Salam, and displayed it before him (the Imam). He (the Imam) said, ‘He has spoken the truth and has made it easy.’ Ibn ‘Udhaynah has said, that Zurarah ibn ‘A‘yan would say so and swear that it is true except that he would say, ‘If she experiences Hayd (menses) her waiting period is one cycle of Hayd (menses) and if she does not experience Hayd (menses) her waiting period is one and a half month.’”

Al-Husayn from Muhammad has narrated from Ahmad ibn Ishaq from Sa‘dan ibn Muslim from ‘Ubayd ibn Zurarah from his father who has said the following: “I once mentioned al-Mut‘ah (advantageous marriage) before abu ‘Abd Allah, ‘Alayhi al-Salam, and asked if it is one of four (wives). He (the Imam) said, ’You may marry a thousand of them; they are on hire. 5 ”

    1. Ali ibn Ibrahim has narrated from his father from ibn abu ‘ Umayr from Afi ibn Yaqtin who has said the following: “I once asked abu al-Hassan, Musa, ‘Alayhi al-Salam, about al-Mut‘ah (advantageous marriage). He (the Imam) said, ‘What do you have to do with it when Allah has made you free of need for it?’ I then said, ‘I only wanted to know about it.’ He (the Imam) said, ‘It is in the book of Ali, ‘Alayhi al-Salam .’ I then asked, ‘Can we extend and they women extend (the time)?’ He (the Imam) said, ‘What else makes him happy?”’

Ali ibn Ibrahim has narrated from al-Mukhtar ibn Muhammad al-Mukhtar and Muhammad ibn al-Hassan from ‘Abd Allah ibn al- Hassan al-’Alawiy all from al-Fath ibn Yazid who has said the following: “I once asked abu al-Hassan, ‘Alayhi al-Salam, about al-Mut‘ah (advantageous marriage). He (the Imam) said, ‘It is lawful, permissible and available for those whom Allah has not made free of need for marriage, so he can maintain chastity by means of al-Mut‘ah (advantageous marriage), and when he is free of such need by means of marriage, then it is permissible in the absence of his wife.’”

    3- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ عَنْ مُحَمَّدِ بْنِ الْحَسَنِ بْنِ شَمُّونٍ قَالَ كَتَبَ أَبُو الْحَسَنِ (عَلَيْهِ السَّلام) إِلَى بَعْضِ مَوَالِيهِ لا تُلِحُّوا عَلَى الْمُتْعَةِ إِنَّمَا عَلَيْكُمْ إِقَامَةُ السُّنَّةِ فَلا تَشْتَغِلُوا بِهَا عَنْ فُرُشِكُمْ وَحَرَائِرِكُمْ فَيَكْفُرْنَ وَيَتَبَرَّيْنَ وَيَدْعِينَ عَلَى الآمِرِ بِذَلِكَ وَيَلْعَنُونَا.

    3. A number of our people have narrated from Sahl ibn Ziyad from Muhammad ibn al-Hassan ibn Shammun who has said the following: “Abu al-Hassan, ‘Alayhi al-Salam, once wrote to certain ones of his followers and it (the letter) said, ‘You must not insist on al-Mut‘ah (advantageous marriage). You only have to maintain the Sunnah. You must not involve in it to ignore your bed (wives) and your free ones to cause them turn to disbelief, disowning and claim against the command for it ( al-Mut‘ah (advantageous marriage)) and condemn us.’”

    4- عَلِيُّ بْنُ مُحَمَّدٍ عَنْ صَالِحِ بْنِ أَبِي حَمَّادٍ عَنِ ابْنِ سِنَانٍ عَنِ الْمُفَضَّلِ بْنِ عُمَرَ قَالَ سَمِعْتُ أَبَا عَبْدِ اللهِ (عَلَيْهِ السَّلام) يَقُولُ فِي الْمُتْعَةِ دَعُوهَا أَمَا يَسْتَحْيِي أَحَدُكُمْ أَنْ يُرَى فِي مَوْضِعِ الْعَوْرَةِ فَيُحْمَلَ ذَلِكَ عَلَى صَالِحِي إِخْوَانِهِ وَأَصْحَابِهِ.

    4. Ali ibn Muhammad has narrated from Salih ibn abu Hammad from ibn Sinan from al-Mufaddal ibn ‘Umar who has said the following: “I once heard abu ‘Abd Allah, ‘Alayhi al-Salam, saying about al-Mut‘ah (advantageous marriage), ‘Stay away from it. Do you not feel ashamed of being seen in a place for which your virtuous brothers in belief and friends feel embarrassed?”’

    1- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنِ ابْنِ مَحْبُوبٍ عَنْ أَبَانٍ عَنْ أَبِي مَرْيَمَ عَنْ أَبِي جَعْفَرٍ (عَلَيْهِ السَّلام) أَنَّهُ سُئِلَ عَنِ الْمُتْعَةِ فَقَالَ إِنَّ الْمُتْعَةَ الْيَوْمَ لَيْسَ كَمَا كَانَتْ قَبْلَ الْيَوْمِ إِنَّهُنَّ كُنَّ يَوْمَئِذٍ يُؤْمَنَّ وَالْيَوْمَ لا يُؤْمَنَّ فَاسْأَلُوا عَنْهُنَّ.

    1. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ibn Mahbub from Aban from abu Maryam who has said the following: “Once, abu Ja‘far, ‘Alayhi al-Salam, was asked about al-Mut‘ah (advantageous marriage). He (the Imam) said, ‘Al-Mut‘ah (advantageous marriage) today is not like it was before this day. Women in those days believed in it but today they do not believe in it and you can ask them.”’

    2- وَعَنْهُ عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنِ الْعَبَّاسِ بْنِ مُوسَى عَنْ إِسْحَاقَ عَنْ أَبِي سَارَةَ قَالَ سَأَلْتُ أَبَا عَبْدِ اللهِ (عَلَيْهِ السَّلام) عَنْهَا يَعْنِي الْمُتْعَةَ فَقَالَ لِي حَلالٌ فَلا تَتَزَوَّجْ إِلا عَفِيفَةً إِنَّ اللهَ عَزَّ وَجَلَّ يَقُولُ وَالَّذِينَ هُمْ لِفُرُوجِهِمْ حافِظُونَ فَلا تَضَعْ فَرْجَكَ حَيْثُ لا تَأْمَنُ عَلَى دِرْهَمِكَ.

    2. It is narrated from the narrator of the previous Hadith from Ahmad ibn Muhammad from al-‘Abbas ibn Musa from Ishaq from abu Sarah who has said the following: “This is concerning my question before abu ‘ Abd Allah, Alayhi al-Salam, about it ( al-Mut‘ah (advantageous marriage)). He (the Imam) said to me, Tt is lawful but you must not marry except those who possess chastity; Allah, most Majestic, most Glorious, says, “. . .those who protect their private organs. ”(23: 5) Therefore, do not marry one whom you cannot trust about your dirham.’”

    3- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ مُحَمَّدِ بْنِ إِسْمَاعِيلَ قَالَ سَأَلَ رَجُلٌ أَبَا الْحَسَنِ الرِّضَا (عَلَيْهِ السَّلام) وَأَنَا أَسْمَعُ عَنْ رَجُلٍ يَتَزَوَّجُ امْرَأَةً مُتْعَةً وَيَشْتَرِطُ عَلَيْهَا أَنْ لا يَطْلُبَ وَلَدَهَا فَتَأْتِي بَعْدَ ذَلِكَ بِوَلَدٍ فَشَدَّدَ فِي إِنْكَارِ الْوَلَدِ وَقَالَ أَيَجْحَدُهُ إِعْظَاماً لِذَلِكَ فَقَالَ الرَّجُلُ فَإِنِ اتَّهَمَهَا فَقَالَ لا يَنْبَغِي لَكَ أَنْ تَتَزَوَّجَ إِلا مُؤْمِنَةً أَوْ مُسْلِمَةً فَإِنَّ اللهَ عَزَّ وَجَلَّ يَقُولُ الزَّانِي لا يَنْكِحُ إِلا زانِيَةً أَوْ مُشْرِكَةً وَالزَّانِيَةُ لا يَنْكِحُها إِلا زانٍ أَوْ مُشْرِكٌ وَحُرِّمَ ذلِكَ عَلَى الْمُؤْمِنِينَ‏.

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Muhammad ibn ‘Isma’il who has said the following: “A man once asked al-Rida’, Alayhi al-Salam, when I was listening, about the case of a man who married a woman in the manner of al-Mut‘ah (advantageous marriage) with the condition that he was not to support her child. She thereafter brought a child to him and he strongly denied the child. He (the Imam) said, ‘Does he deny it because of its greatness?’ The man replied, ‘He accuses her (of wrong doing).’ He (the Imam) said, Tt is not proper for you to marry anyone other than believing, Muslim female because Allah, most Majestic, most Glorious, says, “The fornicator cannot marry but a female fornicator or a female pagan and a female fornicator cannot marry anyone other than a male fornicator or a pagan and it is unlawful to believing people.” (23:3)’”

Ali ibn Ibrahim has narrated from his father from ibn abu ‘Umayr from in a marfu’ manner from ‘Abd Allah ibn abu Ya’fur who has said the following: “This is concerning my question before abu ‘Abd Allah, Alayhi al-Salam, about the case of a woman whose condition is not known; if a man can marry her in the manner of al-Mut‘ah (advantageous marriage). He (the Imam) said, ‘He can propose unlawful activities; if she agreed, he then must stay away from her.’”

    5- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ الْبَرْقِيِّ عَنْ دَاوُدَ بْنِ إِسْحَاقَ الْحَذَّاءِ عَنْ مُحَمَّدِ بْنِ الْفَيْضِ قَالَ سَأَلْتُ أَبَا عَبْدِ اللهِ (عَلَيْهِ السَّلام) عَنِ الْمُتْعَةِ فَقَالَ نَعَمْ إِذَا كَانَتْ عَارِفَةً قُلْنَا جُعِلْنَا فِدَاكَ فَإِنْ لَمْ تَكُنْ عَارِفَةً قَالَ فَاعْرِضْ عَلَيْهَا وَقُلْ لَهَا فَإِنْ قَبِلَتْ فَتَزَوَّجْهَا وَإِنْ أَبَتْ أَنْ تَرْضَى بِقَوْلِكَ فَدَعْهَا وَإِيَّاكَ وَالْكَوَاشِفَ وَالدَّوَاعِيَ وَالْبَغَايَا وَذَوَاتِ الأزْوَاجِ قُلْتُ مَا الْكَوَاشِفُ قَالَ اللَّوَاتِي يُكَاشِفْنَ وَبُيُوتُهُنَّ مَعْلُومَةٌ وَيُؤْتَيْنَ قُلْتُ فَالدَّوَاعِي قَالَ اللَّوَاتِي يَدَّعِينَ إِلَى أَنْفُسِهِنَّ وَقَدْ عُرِفْنَ بِالْفَسَادِ قُلْتُ فَالْبَغَايَا قَالَ الْمَعْرُوفَاتُ بِالزِّنَا قُلْتُ فَذَوَاتُ الأزْوَاجِ قَالَ الْمُطَلَّقَاتُ عَلَى غَيْرِ السُّنَّةِ.

A number of our people have narrated from Ahmad ibn Muhammad from al-Barqiy from Dawud ibn Ishaq al-Hadhdha’ from Muhammad ibn al-Fayd who has said the following: “This is concerning my question before abu ‘Abd Allah, Alayhi al-Salam, about al-Mut‘ah (advantageous marriage). He (the Imam) said, ‘Yes, if she is knowledgeable.’ We then asked him (the Imam), ‘We pray to Allah to keep our souls in service for your cause, what happens if she is not knowledgeable?’ He (the Imam) said, ‘Propose to her if she agrees then marry her, if she refuses to accept your words then stay away from her. You must remain on your guard against al-Kawashif, al- Dawa‘iy, al-Baghaya’ and Dhaxvat al-Azwaj.’ I then asked who are al-Kaxvashif?’ He (the Imam) said, ‘They are those whose houses are known to people and people go to them.’ I asked about al-Dawa‘iy and he (the Imam) said, ‘They are those women who call people to themselves and who are known for indecent acts.’ I then asked about al-Baghaya’ and he (the Imam) said, They are those who are known for their committing fornication.’ I then asked about Dhaxvat al-Azwaj and he (the Imam) said, They are those who are not divorced according to the Sunnah.’”

    6- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ مُحَمَّدِ بْنِ عِيسَى عَنْ يُونُسَ عَنْ مُحَمَّدِ بْنِ الْفُضَيْلِ قَالَ سَأَلْتُ أَبَا الْحَسَنِ (عَلَيْهِ السَّلام) عَنِ الْمَرْأَةِ الْحَسْنَاءِ الْفَاجِرَةِ هَلْ يَجُوزُ لِلرَّجُلِ أَنْ يَتَمَتَّعَ مِنْهَا يَوْماً أَوْ أَكْثَرَ فَقَالَ إِذَا كَانَتْ مَشْهُورَةً بِالزِّنَا فَلا يَتَمَتَّعْ مِنْهَا وَلا يَنْكِحْهَا.

    6. Ali ibn Ibrahim has narrated from Muhammad ibn ‘Isa from Yunus from Muhammad ibn af-Fudayl who has said the following: “I once asked abu al-Hassan, ‘Alayhi al-Salam, about the case of a woman who was beautiful but was involved in indecent acts if it was permissible to form al-Mut‘ah (advantageous marriage) with her for a day or more. He (the Imam) said, ’If she is known as a fornicator then al-Mut‘ah (advantageous marriage) is not proper with her as well as marriage.’”

    1- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ وَمُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ جَمِيعاً عَنِ ابْنِ مَحْبُوبٍ عَنْ جَمِيلِ بْنِ صَالِحٍ عَنْ زُرَارَةَ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ لا تَكُونُ مُتْعَةٌ إِلا بِأَمْرَيْنِ أَجَلٍ مُسَمًّى وَأَجْرٍ مُسَمًّى.

    1. A number of our people have narrated from Sahl ibn Ziyad and Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad all from ibn Mahbub from Jamil ibn Salih from Zurarah who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘Al-Mut‘ah (advantageous marriage) cannot take place without two issues: they are the duration of time and the amount of mahr (dower).”’

    2- مُحَمَّدُ بْنُ يَحْيَى عَنْ مُحَمَّدِ بْنِ الْحُسَيْنِ وَعِدَّةٌ مِنْ أَصْحَابِنَا عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ عُثْمَانَ بْنِ عِيسَى عَنْ سَمَاعَةَ عَنْ أَبِي بَصِيرٍ قَالَ لا بُدَّ مِنْ أَنْ تَقُولَ فِي هَذِهِ الشُّرُوطِ أَتَزَوَّجُكِ مُتْعَةً كَذَا وَكَذَا يَوْماً بِكَذَا وَكَذَا دِرْهَماً نِكَاحاً غَيْرَ سِفَاحٍ عَلَى كِتَابِ اللهِ عَزَّ وَجَلَّ وَسُنَّةِ نَبِيِّهِ (صَلَّى اللهُ عَلَيْهِ وَآلِه) وَعَلَى أَنْ لا تَرِثِينِي وَلا أَرِثَكِ وَعَلَى أَنْ تَعْتَدِّي خَمْسَةً وَأَرْبَعِينَ يَوْماً وَقَالَ بَعْضُهُمْ حَيْضَةً.

    2. Muhammad ibn Yahya has narrated from Muhammad ibn al-Husayn and a number of our people have narrated from Ahmad ibn Muhammad from ‘Uthman ibn ‘Isa from Sama‘ah from abu Basir who has said the following: “He (the Imam), ‘Alayhi al-Salam, has said, ‘It is necessary that in marriage in the manner of al- Mut‘ah (advantageous marriage) and its conditions one must say, “I form marriage with you in the manner of al-Mut‘ah (advantageous marriage) for so and so many days with such and such amount of dirham as mahr (dower), a marriage free of indecency according to the book of Allah, most Majestic, most Glorious, and the Sunnah of Allah’s Holy prophet, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, that you will not inherit me and I will not inherit you and that you must complete forty- five days of waiting period’” and certain ones have said that it is one cycle of Hayd (menses).”

    3- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنْ عَمْرِو بْنِ عُثْمَانَ عَنْ إِبْرَاهِيمَ بْنِ الْفَضْلِ عَنْ أَبَانِ بْنِ تَغْلِبَ وَعَلِيُّ بْنُ مُحَمَّدٍ عَنْ سَهْلِ بْنِ زِيَادٍ عَنْ إِسْمَاعِيلَ بْنِ مِهْرَانَ وَمُحَمَّدِ بْنِ أَسْلَمَ عَنْ إِبْرَاهِيمَ بْنِ الْفَضْلِ عَنْ أَبَانِ بْنِ تَغْلِبَ قَالَ قُلْتُ لأبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) كَيْفَ أَقُولُ لَهَا إِذَا خَلَوْتُ بِهَا قَالَ تَقُولُ أَتَزَوَّجُكِ مُتْعَةً عَلَى كِتَابِ اللهِ وَسُنَّةِ نَبِيِّهِ (صَلَّى اللهُ عَلَيْهِ وَآلِه) لا وَارِثَةً وَلا مَوْرُوثَةً كَذَا وَكَذَا يَوْماً وَإِنْ شِئْتَ كَذَا وَكَذَا سَنَةً بِكَذَا وَكَذَا دِرْهَماً وَتُسَمِّي مِنَ الأجْرِ مَا تَرَاضَيْتُمَا عَلَيْهِ قَلِيلا كَانَ أَمْ كَثِيراً فَإِذَا قَالَتْ نَعَمْ فَقَدْ رَضِيَتْ فَهِيَ امْرَأَتُكَ وَأَنْتَ أَوْلَى النَّاسِ بِهَا قُلْتُ فَإِنِّي أَسْتَحْيِي أَنْ أَذْكُرَ شَرْطَ الأيَّامِ قَالَ هُوَ أَضَرُّ عَلَيْكَ قُلْتُ وَكَيْفَ قَالَ إِنَّكَ إِنْ لَمْ تَشْتَرِطْ كَانَ تَزْوِيجَ مُقَامٍ وَلَزِمَتْكَ النَّفَقَةُ فِي الْعِدَّةِ وَكَانَتْ وَارِثَةً وَلَمْ تَقْدِرْ عَلَى أَنْ تُطَلِّقَهَا إِلا طَلاقَ السُّنَّةِ.

    3. Ali ibn Ibrahim has narrated from his father from “Amr ibn ‘Uthman from Ibrahim ibn al-Fadl from Aban ibn Taghlib and Ali ibn Muhammad from Sahl ibn Ziyad from ‘Isma’il ibn Mehran and Muhammad ibn Muslim from Ibrahim ibn al-Fadl from Aban ibn Taghlib who has said the following: “This is concerning my question before abu ‘Abd Allah, ‘Alayhi al-Salam, about what I should say when I am with her. He (the Imam) said, ‘Say I marry you in the manner of al-Mut‘ah (advantageous marriage) according to the book of Allah and the Sunnah of His Holy prophet, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, and that there is no inheritor or inherited in it, for so and so many days or if you wished, for so and so many years, for so and so much amount of dirham as mahr (dower),’ mention the amount you both have agreed, little or more, then if she said, “Yes,” it means she has agreed. She is your wife and you are the nearest of all people to her.’ I then said, ‘I feel embarrassed to mention the condition of days.’ He (the Imam) said, ‘It (such feeling) is more harmful to you.’ I then asked, ‘Why is it as such?’ He (the Imam) said, ‘If you do not mention, marriage is permanent, you must pay her expenses during waiting period, there will be inheritance and you cannot divorce her except in the form of divorce according to the Sunnah.’”

    4- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي نَصْرٍ عَنْ ثَعْلَبَةَ قَالَ تَقُولُ أَتَزَوَّجُكِ مُتْعَةً عَلَى كِتَابِ اللهِ وَسُنَّةِ نَبِيِّهِ (صَلَّى اللهُ عَلَيْهِ وَآلِه) نِكَاحاً غَيْرَ سِفَاحٍ وَعَلَى أَنْ لا تَرِثِينِي وَلا أَرِثَكِ كَذَا وَكَذَا يَوْماً بِكَذَا وَكَذَا دِرْهَماً وَعَلَى أَنَّ عَلَيْكِ الْعِدَّةَ.

    4. Ali ibn Ibrahim has narrated from his father from ibn abu Nasr from Tha’labah who has said the following: “He (the Imam), ‘Alayhi al-Salam, has said, say, ‘I marry you in the manner of al-Mut‘ah (advantageous marriage) according to the book of Allah and the Sunnah of His Holy prophet, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, a marriage which is not indecency and that you will not inherit me and I will not inherit you, for so and so amount of dirham as mahr (dower) and that you must complete the waiting period.’”

    5- مُحَمَّدُ بْنُ يَحْيَى عَنْ عَبْدِ اللهِ بْنِ مُحَمَّدٍ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ هِشَامِ بْنِ سَالِمٍ قَالَ قُلْتُ كَيْفَ يَتَزَوَّجُ الْمُتْعَةَ قَالَ تَقُولُ يَا أَمَةَ اللهِ أَتَزَوَّجُكِ كَذَا وَكَذَا يَوْماً بِكَذَا وَكَذَا دِرْهَماً فَإِذَا مَضَتْ تِلْكَ الأيَّامُ كَانَ طَلاقُهَا فِي شَرْطِهَا وَلا عِدَّةَ لَهَا عَلَيْكَ.

    5. Muhammad ibn Yahya has narrated from ‘Abd Allah ibn Muhammad ibn abu ‘Umayr from Hisham ibn Salim who has said the following: “I once asked him (the Imam), ‘Alayhi al-Salam, about how al-Mut‘ah (advantageous marriage) is formed?’ He (the Imam) said that you must say, ‘O female servant of Allah, I marry you for so and so many days for such and such amount of dirham as mahr (dower).’ When the days pass her divorce is her condition and she does not need waiting period.’”

    1- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ عَبْدِ اللهِ بْنِ بُكَيْرٍ قَالَ قَالَ أَبُو عَبْدِ اللهِ (عَلَيْهِ السَّلام) مَا كَانَ مِنْ شَرْطٍ قَبْلَ النِّكَاحِ هَدَمَهُ النِّكَاحُ وَمَا كَانَ بَعْدَ النِّكَاحِ فَهُوَ جَائِزٌ وَقَالَ إِنْ سُمِّيَ الأجَلُ فَهُوَ مُتْعَةٌ وَإِنْ لَمْ يُسَمَّ الأجَلُ فَهُوَ نِكَاحٌ بَاتٌّ.

    1. Ali ibn Ibrahim has narrated from his father from ibn abu ‘Umayr from ‘Abd Allah ibn Bukayr who has said the following: “Any condition before marriage becomes invalid by marriage and the condition after marriage is permissible.’ He (the Imam) said, ’If time limit is mentioned it is al-Mut‘ah (advantageous marriage) and if time limit is not mentioned it is permanent.’”

    2- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ عَنِ ابْنِ مَحْبُوبٍ عَنِ ابْنِ رِئَابٍ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ قَالَ سَأَلْتُ أَبَا عَبْدِ اللهِ (عَلَيْهِ السَّلام) عَنْ قَوْلِ اللهِ عَزَّ وَجَلَّ وَلا جُناحَ عَلَيْكُمْ فِيما تَراضَيْتُمْ بِهِ مِنْ بَعْدِ الْفَرِيضَةِ فَقَالَ مَا تَرَاضَوْا بِهِ مِنْ بَعْدِ النِّكَاحِ فَهُوَ جَائِزٌ وَمَا كَانَ قَبْلَ النِّكَاحِ فَلا يَجُوزُ إِلا بِرِضَاهَا وَبِشَيْ‏ءٍ يُعْطِيهَا فَتَرْضَى بِهِ.

    2. A number of our people have narrated from Sahl ibn Ziyad from ibn Mahbub from ibn Ri’ab from Muhammad ibn Muslim who has said the following: “This is concerning my question before abu ‘Abd Allah, ‘Alayhi al-Salam, about the words of Allah, most Majestic, most Glorious, 4 . . . it is not harmful for you if you agree upon it after marriage.’ (4:24) He (the Imam) said, ‘Whatever they agree upon after marriage is permissible and whatever is before marriage is not permissible except with her agreement and with something given to her to make her agree.’”

    3- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ أَحْمَدَ بْنِ أَبِي عَبْدِ اللهِ عَنْ أَبِيهِ عَنْ سُلَيْمَانَ بْنِ سَالِمٍ عَنِ ابْنِ بُكَيْرٍ قَالَ قَالَ أَبُو عَبْدِ اللهِ (عَلَيْهِ السَّلام) إِذَا اشْتَرَطْتَ عَلَى الْمَرْأَةِ شُرُوطَ الْمُتْعَةِ فَرَضِيَتْ بِهِ وَأَوْجَبَتِ التَّزْوِيجَ فَارْدُدْ عَلَيْهَا شَرْطَكَ الأوَّلَ بَعْدَ النِّكَاحِ فَإِنْ أَجَازَتْهُ فَقَدْ جَازَ وَإِنْ لَمْ تُجِزْهُ فَلا يَجُوزُ عَلَيْهَا مَا كَانَ مِنَ الشَّرْطِ قَبْلَ النِّكَاحِ.

    3. A number of our people have narrated from Ahmad ibn abu ‘Abd Allah from his father from Sulayman ibn Salim from ibn Bukayr who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘When you settle the conditions of al-Mut‘ah (advantageous marriage) with a woman and she agrees and marriage becomes binding, you can bring your prior condition after marriage; if she agrees it is permissible, if she does not agree, it does not apply effectively to her; it was before marriage.’”

    4. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ibn Faddal from ibn Bukayr from Muhammad ibn Muslim who has said the following: “I once heard abu Ja‘far, ‘Alayhi al-Salam, saying, about the case of a man who marries in the manner of al-Mut‘ah (advantageous marriage) ‘They inherit each other if they do not set a condition because condition is effective after marriage.’”

A number of our people have narrated from Sahl ibn Ziyad from Ahmad ibn Muhammad from ibn abu Nasr and ‘Abd al-Rahman ibn abu Najran from ‘Asem ibn Hamid from Muhammad ibn Muslim who has said the following: “In response to my question before abu ‘Abd Allah, ‘Alayhi al-Salam, about how much mahr (dower) is - in al-Mut‘ah (advantageous marriage), he (the Imam) said, ‘It is whatever they agree on, up to the time they want.’”

    2. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from al-Husayn ibn Sa‘id Ahmad ibn Muhammad from Muhammad ibn Khalid al-Barqiy from al-Qasim ibn Muhammad al-Jawhariy from abu Sa‘id from al-Ahwal who has said the following: “This is concerning my question before abu ‘Abd Allah, ‘Alayhi al-Salam, about the minimum amount of mahr (dower) in al-Mut‘ah (advantageous marriage). He (the Imam) said, ‘It can be a handful of wheat.’”

    3. Ahmad ibn Muhammad has narrated from al-Husayn ibn Sa‘id from Hammad ibn ‘Isa from Shu’ayb ibn Ya’qub from abu Basir who has said the following: “I once asked abu Ja‘far, ‘Alayhi al-Salam, about al-Mut‘ah (advantageous marriage) of women. He (the Imam) said, ‘It is lawful and one dirham or more is enough (as mahr (dower)).”’

    4. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from Ali ibn abu Hamzah from abu Basir who has said the following: “This is concerning my question before abu ‘Abd Allah, ‘Alayhi al-Salam, about mahr (dower) in al- Mut‘ah (advantageous marriage) and that what it is? He (the Imam) said, ‘It can be a handful of food items, wheat flour, or fine flour or dates.’”

    5. Ali ibn Ibrahim has narrated from Muhammad ibn ‘Isa from Yunus from certain persons of our people who have said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘The minimum amount of mahr (dower) in al-Mut‘ah (advantageous marriage) can be even a handful of food.’ Certain ones of them have narrated that even a Miswak (toothbrush) is acceptable.”

    1- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ عُمَرَ بْنِ أُذَيْنَةَ عَنْ زُرَارَةَ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) أَنَّهُ قَالَ إِنْ كَانَتْ تَحِيضُ فَحَيْضَةٌ وَإِنْ كَانَتْ لا تَحِيضُ فَشَهْرٌ وَنِصْفٌ.

    1. Ali ibn Ibrahim has narrated from his father from ibn abu ‘Umayr from ‘Umar ibn ‘Udhaynah from Zurarah who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘Waiting period in al-Mut‘ah (advantageous marriage) is one cycle of Hayd (menses) if she experiences Hayd (menses); and if she does not experience Hayd (menses) then it is one and a half month.’”

    2- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ عَنْ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ أَبِي نَصْرٍ عَنْ أَبِي الْحَسَنِ الرِّضَا (عَلَيْهِ السَّلام) قَالَ قَالَ أَبُو جَعْفَرٍ (عَلَيْهِ السَّلام) عِدَّةُ الْمُتْعَةِ خَمْسَةٌ وَأَرْبَعُونَ يَوْماً وَالاحْتِيَاطُ خَمْسٌ وَأَرْبَعُونَ لَيْلَةً.

    2. A number of our people have narrated from Sahl ibn Ziyad from Ahmad ibn Muhammad from ibn abu Nasr who has said the following: “Abu al-Hassan al-Rida’ has said that abu Ja‘far, ‘Alayhi al-Salam, has said, ‘Waiting period for al- Mut‘ah (advantageous marriage) is forty five days and because of precaution it is forty five nights.’”

    3- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنِ ابْنِ فَضَّالٍ عَنِ ابْنِ بُكَيْرٍ عَنْ زُرَارَةَ قَالَ عِدَّةُ الْمُتْعَةِ خَمْسَةٌ وَأَرْبَعُونَ يَوْماً كَأَنِّي أَنْظُرُ إِلَى أَبِي جَعْفَرٍ (عَلَيْهِ السَّلام) يَعْقِدُ بِيَدِهِ خَمْسَةً وَأَرْبَعِينَ فَإِذَا جَازَ الأجَلُ كَانَتْ فُرْقَةٌ بِغَيْرِ طَلاقٍ.

    3. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ibn Faddal from ibn Bukayr from Zurarah who has said the following: “He (the Imam), ‘Alayhi al-Salam, has said, ‘Waiting period of al-Mut‘ah (advantageous marriage) is forty five days. It is as if I see my father count it on his fingers as forty-five and when this time passes separation between them takes place without divorce.’”

    1- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ وَعَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ جَمِيعاً عَنْ عَبْدِ الرَّحْمَنِ بْنِ أَبِي نَجْرَانَ وَأَحْمَدَ بْنِ مُحَمَّدِ بْنِ أَبِي نَصْرٍ عَنْ أَبِي بَصِيرٍ قَالَ لا بَأْسَ بِأَنْ تَزِيدَكَ وَتَزِيدَهَا إِذَا انْقَطَعَ الأجَلُ فِيمَا بَيْنَكُمَا تَقُولُ اسْتَحْلَلْتُكِ بِأَجَلٍ آخَرَ بِرِضاً مِنْهَا وَلا يَحِلُّ ذَلِكَ لِغَيْرِكَ حَتَّى تَنْقَضِيَ عِدَّتُهَا.

    1. A number of our people have narrated from Sahl ibn Ziyad and Ali ibn Ibrahim has narrated from his father all from ‘Abd al-Rahman ibn abu Najran and Ahmad ibn abu Nasr from abu Basir who has said the following: “He (the Imam), ‘Alayhi al-Salam, has said, ‘It is permissible if she extends for you and you extend for her when the time for both of you expires, by saying, ‘I have made you lawful to myself up to another period of time with your agreement’ and this is not lawful for anyone other than you until it expires.’”

    2- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنْ عَمْرِو بْنِ عُثْمَانَ عَنْ إِبْرَاهِيمَ بْنِ الْفَضْلِ وَعِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ عَنْ إِسْمَاعِيلَ بْنِ مِهْرَانَ عَنْ مُحَمَّدِ بْنِ أَسْلَمَ وَعَنْ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ خَالِدٍ عَنْ مُحَمَّدِ بْنِ عَلِيٍّ عَنْ مُحَمَّدِ بْنِ أَسْلَمَ عَنْ إِبْرَاهِيمَ بْنِ الْفَضْلِ الْهَاشِمِيِّ عَنْ أَبَانِ بْنِ تَغْلِبَ قَالَ قُلْتُ لأبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) جُعِلْتُ فِدَاكَ الرَّجُلُ يَتَزَوَّجُ الْمَرْأَةَ مُتْعَةً فَيَتَزَوَّجُهَا عَلَى شَهْرٍ ثُمَّ إِنَّهَا تَقَعُ فِي قَلْبِهِ فَيُحِبُّ أَنْ يَكُونَ شَرْطُهُ أَكْثَرَ مِنْ شَهْرٍ فَهَلْ يَجُوزُ أَنْ يَزِيدَهَا فِي أَجْرِهَا وَيَزْدَادَ فِي الأيَّامِ قَبْلَ أَنْ تَنْقَضِيَ أَيَّامُهُ الَّتِي شَرَطَ عَلَيْهَا فَقَالَ لا لا يَجُوزُ شَرْطَانِ فِي شَرْطٍ قُلْتُ فَكَيْفَ يَصْنَعُ قَالَ يَتَصَدَّقُ عَلَيْهَا بِمَا بَقِيَ مِنَ الأيَّامِ ثُمَّ يَسْتَأْنِفُ شَرْطاً جَدِيداً.

    2. Ali ibn Ibrahim has narrated from his father from ibn abu ‘Umayr from ‘Amr ibn ‘Uthman from Ibrahim ibn al-Fadl and A number of our people have narrated from Sahl ibn Ziyad from ‘Isma’il ibn Mehran from Muhammad ibn Aslam and Ahmad ibn Muhammad ibn Khalid from Muhammad ibn Ali from Muhammad ibn Aslam from Ibrahim ibn al-Fadl al-Hashimiy from Aban ibn Taghlib who has said the following: “This is concerning my question before abu ‘Abd Allah, ‘Alayhi al-Salam, about the case of a man who marries a woman in the manner of al-Mut‘ah (advantageous marriage) for the duration of one month. Then it comes to his heart and he likes to have a condition for more than a month; if it is permissible to increase in her mahr (dower) to extend the number of days before it (the time already set) expires. He (the Imam) said, ‘No, two conditions in one and the same condition are not permissible.’ I then asked, ‘What must he do about it?’ He (the Imam) said, ‘She can give up the remaining of the time in his favor as charity and then initiate a new condition of extension of time.’”

    3- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَمَّنْ رَوَاهُ قَالَ إِنَّ الرَّجُلَ إِذَا تَزَوَّجَ الْمَرْأَةَ مُتْعَةً كَانَ عَلَيْهَا عِدَّةٌ لِغَيْرِهِ فَإِذَا أَرَادَ هُوَ أَنْ يَتَزَوَّجَهَا لَمْ يَكُنْ عَلَيْهَا مِنْهُ عِدَّةٌ يَتَزَوَّجُهَا إِذَا شَاءَ.

    3. Ali ibn Ibrahim has narrated from his father from ibn abu ‘Umayr from those who narrated to him who has said the following: “He (the Imam), ‘Alayhi al-Salam, has said, ‘If a woman marries a man in the manner of al-Mut‘ah (advantageous marriage) she must complete waiting period for others. However, if the same man wants to marry her again because of him she does not need to complete a waiting period, so she can marry him in the manner of al-Mut‘ah (advantageous marriage) whenever she wants.’”

    1- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ عَنِ ابْنِ مَحْبُوبٍ عَنْ عَلِيِّ بْنِ رِئَابٍ عَنْ عُمَرَ بْنِ حَنْظَلَةَ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ يُشَارِطُهَا مَا شَاءَ مِنَ الأيَّامِ.

    1. A number of our people have narrated from Sahl ibn Ziyad from ibn Mahbub from ibn Ri’ab from ‘Umar ibn Hanzalah who has said the following: “Abu ‘ Abd Allah, ‘Alayhi al-Salam, has said, ‘He can arrange for a mutual agreement with her for any number of days they want.’”

    2- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ مُحَمَّدِ بْنِ إِسْمَاعِيلَ عَنْ أَبِي الْحَسَنِ الرِّضَا (عَلَيْهِ السَّلام) قَالَ قُلْتُ لَهُ الرَّجُلُ يَتَزَوَّجُ مُتْعَةً سَنَةً أَوْ أَقَلَّ أَوْ أَكْثَرَ قَالَ إِذَا كَانَ شَيْئاً مَعْلُوماً إِلَى أَجَلٍ مَعْلُومٍ قَالَ قُلْتُ وَتَبِينُ بِغَيْرِ طَلاقٍ قَالَ نَعَمْ.

    2. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Muhammad ibn ‘Isma’il who has said the following: “In response to my question before al-Rida’, ‘Alayhi al-Salam, about the case of a man who marries in the manner of al-Mut‘ah (advantageous marriage) for one year or less or more, he (the Imam) said, ‘It is permissible if it is a known matter for a known number of days.’ I then asked if it terminates without divorce. He (the Imam) said, ‘Yes, it terminates without divorce.”’
