    2- سَهْلُ بْنُ زِيَادٍ وَمُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ جَمِيعاً عَنْ عَلِيِّ بْنِ مَهْزِيَارَ قَالَ كَتَبَ عَلِيُّ بْنُ أَسْبَاطٍ إِلَى أَبِي جَعْفَرٍ (عَلَيْهِ السَّلام) فِي أَمْرِ بَنَاتِهِ وَأَنَّهُ لا يَجِدُ أَحَداً مِثْلَهُ فَكَتَبَ إِلَيْهِ أَبُو جَعْفَرٍ (عَلَيْهِ السَّلام) فَهِمْتُ مَا ذَكَرْتَ مِنْ أَمْرِ بَنَاتِكَ وَأَنَّكَ لا تَجِدُ أَحَداً مِثْلَكَ فَلا تَنْظُرْ فِي ذَلِكَ رَحِمَكَ اللهُ فَإِنَّ رَسُولَ اللهِ (صَلَّى اللهُ عَلَيْهِ وَآلِه) قَالَ إِذَا جَاءَكُمْ مَنْ تَرْضَوْنَ خُلُقَهُ وَدِينَهُ فَزَوِّجُوهُ إِلا تَفْعَلُوهُ تَكُنْ فِتْنَةٌ فِي الأرْضِ وَفَسادٌ كَبِيرٌ.

    2. Sahl ibn Ziyad Ahmad ibn Muhammad from Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from all from Ali ibn Mahziyar from who has said the following: “Ali ibn Asbat once wrote to abu Ja‘far, ‘Alayhi al-Salam, about the issue of his daughters and that he cannot find anyone as equal match for them. He (the Imam), ‘Alayhi al-Salam, wrote to him, ‘I understood what you have written about the issue of your daughters that you do not find anyone as their equal match, you must not see to it, may Allah grant you kindness, because the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, has said, “If one proposes marriage and you are happy with his health and religion, then accept his proposal.” If you do not do so mischief and great destruction can take place in the land.’”

    3- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ أَحْمَدَ بْنِ أَبِي عَبْدِ اللهِ عَنْ إِبْرَاهِيمَ بْنِ مُحَمَّدٍ الْهَمَذَانِيِّ قَالَ كَتَبْتُ إِلَى أَبِي جَعْفَرٍ (عَلَيْهِ السَّلام) فِي التَّزْوِيجِ فَأَتَانِي كِتَابُهُ بِخَطِّهِ قَالَ رَسُولُ اللهِ (صَلَّى اللهُ عَلَيْهِ وَآلِه) إِذَا جَاءَكُمْ مَنْ تَرْضَوْنَ خُلُقَهُ وَدِينَهُ فَزَوِّجُوهُ إِلا تَفْعَلُوهُ تَكُنْ فِتْنَةٌ فِي الأرْضِ وَفَسادٌ كَبِيرٌ.

    3. A number of our people have narrated from Ahmad ibn abu ‘Abd Allah from Ibrahim ibn Muhammad al-Hamadaniy who has said the following: “I once wrote to abu Ja‘far, ‘Alayhi al-Salam, about marriage then his letter came to me with his handwriting that said, ‘The Messenger of Allah, ‘O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, has said, “If one proposes marriage and you are happy with his health and religion then accept his proposal. If you do not do so mischief and great destruction may take place in the land.’”

    1- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ عَلِيِّ بْنِ الْحَكَمِ عَنْ أَبَانٍ عَنْ رَجُلٍ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ الْكُفْوُ أَنْ يَكُونَ عَفِيفاً وَعِنْدَهُ يَسَارٌ.

    1. A number of our people have narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from Aban from a man who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘Proper match is one who is chaste and affluent.’”

  4. 9471Al-Kafi

    1- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ رَفَعَهُ قَالَ قَالَ أَبُو عَبْدِ اللهِ (عَلَيْهِ السَّلام) مَنْ زَوَّجَ كَرِيمَتَهُ مِنْ شَارِبِ الْخَمْرِ فَقَدْ قَطَعَ رَحِمَهَا.

    1. A number of our people have narrated from Ahmad ibn Muhammad from in a marfu’ manner has said the following: “Abu ‘ Abd Allah, ‘Alayhi al-Salam, has said, ‘If one gives his daughter in marriage to a man who drinks wine, he has cut off the relation that relatives are commanded to maintain.’”

    2- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ بَعْضِ أَصْحَابِهِ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ قَالَ رَسُولُ اللهِ (صَلَّى اللهُ عَلَيْهِ وَآلِه) شَارِبُ الْخَمْرِ لا يُزَوَّجُ إِذَا خَطَبَ.

    2. Ali ibn Ibrahim has narrated from his father from ibn abu ‘Umayr from certain persons of his people who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said that the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, has said, ‘If one who drinks wine proposes for marriage, it must not be accepted.’”

    3- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنِ الْحَسَنِ بْنِ مَحْبُوبٍ عَنْ خَالِدِ بْنِ جَرِيرٍ عَنْ أَبِي الرَّبِيعِ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ قَالَ رَسُولُ اللهِ (صَلَّى اللهُ عَلَيْهِ وَآلِه) مَنْ شَرِبَ الْخَمْرَ بَعْدَ مَا حَرَّمَهَا اللهُ عَلَى لِسَانِي فَلَيْسَ بِأَهْلٍ أَنْ يُزَوَّجَ إِذَا خَطَبَ.

    3. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from al-Hassan ibn Mahbub from Khalid ibn Jarir from abu al- Rabi‘ who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said that the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, has said, ‘If one who after knowing that Allah has, through my words, made wine unlawful, drinks wine, his proposal for marriage must not be accepted.’”

    1- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ عَنْ أَحْمَدَ بْنِ مُحَمَّدِ بْنِ أَبِي نَصْرٍ عَنْ عَبْدِ الْكَرِيمِ بْنِ عَمْرٍو عَنْ أَبِي بَصِيرٍ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ تَزَوَّجُوا فِي الشُّكَّاكِ وَلا تُزَوِّجُوهُمْ لأنَّ الْمَرْأَةَ تَأْخُذُ مِنْ أَدَبِ زَوْجِهَا وَيَقْهَرُهَا عَلَى دِينِهِ.

    1. A number of our people have narrated from Sahl ibn Ziyad Ahmad ibn Muhammad from ibn abu Nasr from ‘Abd al-Karim ibn ‘(Belief in the Divine Authority of ‘A’immah) from abu Basir who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘You can marry a skeptic but do not give in marriage to a skeptic because a woman follows the manners of her husband, and he compels her into his religion.’”

    2- أَبُو عَلِيٍّ الأشْعَرِيُّ عَنْ مُحَمَّدِ بْنِ عَبْدِ الْجَبَّارِ عَنْ صَفْوَانَ بْنِ يَحْيَى عَنْ عَبْدِ اللهِ بْنِ مُسْكَانَ عَنْ يَحْيَى الْحَلَبِيِّ عَنْ عَبْدِ الْحَمِيدِ الطَّائِيِّ عَنْ زُرَارَةَ بْنِ أَعْيَنَ قَالَ قُلْتُ لأبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) أَتَزَوَّجُ بِمُرْجِئَةٍ أَوْ حَرُورِيَّةٍ قَالَ لا عَلَيْكَ بِالْبُلْهِ مِنَ النِّسَاءِ قَالَ زُرَارَةَ فَقُلْتُ وَاللهِ مَا هِيَ إِلا مُؤْمِنَةٌ أَوْ كَافِرَةٌ فَقَالَ أَبُو عَبْدِ اللهِ (عَلَيْهِ السَّلام) وَأَيْنَ أَهْلُ ثَنْوَى اللهِ عَزَّ وَجَلَّ قَوْلُ اللهِ عَزَّ وَجَلَّ أَصْدَقُ مِنْ قَوْلِكَ إِلا الْمُسْتَضْعَفِينَ مِنَ الرِّجالِ وَالنِّساءِ وَالْوِلْدانِ لا يَسْتَطِيعُونَ حِيلَةً وَلا يَهْتَدُونَ سَبِيلا.

    2. Abu Ali al-Ash’ariy has narrated from Muhammad ibn ‘Abd al-Jabbar from Safwan ibn Yahya from ‘Abd Allah ibn Muskan from Yahya al-Halabiy from ‘Abd al-Hamid al-Ta’iy from Zurarah ibn ‘A‘yan who has said the following: “This is concerning my question before abu ‘Abd Allah, ‘Alayhi al-Salam, if I can marry a Murji’ah or Harawriyah (two sects). He (the Imam) said, ‘No, but you must marry simple hearted woman.’ I then said, ‘By Allah, it is only a believer or unbeliever.’ Abu ‘Abd Allah, ‘Alayhi al-Salam, said, ‘What is the position of Thanawiy (a sect) people about Allah, most Majestic, most Glorious? The words of Allah, most Majestic, most Glorious, are truer than what you say “. . . except the weak ones of man, woman and children who cannot plan or find guidance to the right path. . . ’” (4:101)

    3- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنِ ابْنِ مَحْبُوبٍ عَنْ جَمِيلِ بْنِ صَالِحٍ عَنْ فُضَيْلِ بْنِ يَسَارٍ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ لا يَتَزَوَّجِ الْمُؤْمِنُ النَّاصِبَةَ الْمَعْرُوفَةَ بِذَلِكَ‏.

    3. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ibn Mahbub from Jamil ibn Salih from Fudayl ibn Yasar who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘A believer must not marry one who is hostile to ‘A’immah, ‘Alayhim al-Salam, and his hostility is well known.’”

    4- مُحَمَّدُ بْنُ إِسْمَاعِيلَ عَنِ الْفَضْلِ بْنِ شَاذَانَ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ رِبْعِيٍّ عَنِ الْفُضَيْلِ بْنِ يَسَارٍ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ قَالَ لَهُ الْفُضَيْلُ أَتَزَوَّجُ النَّاصِبَةَ قَالَ لا وَلا كَرَامَةَ قُلْتُ جُعِلْتُ فِدَاكَ وَاللهِ إِنِّي لأقُولُ لَكَ هَذَا وَلَوْ جَاءَنِي بِبَيْتٍ مَلآنَ دَرَاهِمَ مَا فَعَلْتُ.

    4. Muhammad ibn ‘Isma’il has narrated from al-Fadl ibn Shadhan from ibn abu ‘Umayr from Rib’iy from Fudayl ibn Yasar who has said the following: “This is concerning my question before abu ‘Abd Allah, ‘Alayhi al-Salam, if I can marry al-Nasibah (one hostile to ‘A’immah). He (the Imam) said, ‘No, it is not an honor.’ I then said, ‘I pray to Allah to keep my soul in service for your cause, I just say it but even if she comes to me with a whole house full of dirham I will not do so.’”

    5- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ عَلِيِّ بْنِ الْحَكَمِ عَنْ مُوسَى بْنِ بَكْرٍ عَنْ زُرَارَةَ بْنِ أَعْيَنَ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ تَزَوَّجُوا فِي الشُّكَّاكِ وَلا تُزَوِّجُوهُمْ فَإِنَّ الْمَرْأَةَ تَأْخُذُ مِنْ أَدَبِ زَوْجِهَا وَيَقْهَرُهَا عَلَى دِينِهِ.

    5. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from Musa ibn Bakr from Zurarah ibn ‘A‘yan who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘You can marry a skeptic but do not give in marriage to a skeptic; women follow their husband and he compels her into his religion.’”

    6- أَحْمَدُ بْنُ مُحَمَّدٍ عَنِ ابْنِ فَضَّالٍ عَنْ عَلِيِّ بْنِ يَعْقُوبَ عَنْ مَرْوَانَ بْنِ مُسْلِمٍ عَنِ الْحُسَيْنِ بْنِ مُوسَى الْحَنَّاطِ عَنِ الْفُضَيْلِ بْنِ يَسَارٍ قَالَ قُلْتُ لأبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) إِنَّ لامْرَأَتِي أُخْتاً عَارِفَةً عَلَى رَأْيِنَا وَلَيْسَ عَلَى رَأْيِنَا بِالْبَصْرَةِ إِلا قَلِيلٌ فَأُزَوِّجُهَا مِمَّنْ لا يَرَى رَأْيَهَا قَالَ لا وَلا نِعْمَةَ [وَلا كَرَامَةَ] إِنَّ اللهَ عَزَّ وَجَلَّ يَقُولُ فَلا تَرْجِعُوهُنَّ إِلَى الْكُفَّارِ لا هُنَّ حِلٌّ لَهُمْ وَلا هُمْ يَحِلُّونَ لَهُنَّ.

    6. Ahmad ibn Muhammad has narrated from ibn Faddal from Ali ibn Ya’qub from Marwan ibn Muslim from al-Husayn ibn Musa al- Hannat from Fudayl ibn Yasar who has said the following: “This is concerning my question before abu ‘Abd Allah, ‘Alayhi al-Salam, about the case of the sister of my wife who is of the same belief as we are; but in Basra very few people believe as we do; if we can give her in marriage to those who do not believe as we do. He (the Imam) said, ‘No, it is not a bounty or honor. Allah, most Majestic, most Glorious, says, “You must not return them to unbelievers; they (women) are not lawful for them (unbelievers) and they are not lawful for them (women).” (6:10)’”

    7- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ جَمِيلِ بْنِ دَرَّاجٍ عَنْ زُرَارَةَ قَالَ قُلْتُ لأبِي جَعْفَرٍ (عَلَيْهِ السَّلام) إِنِّي أَخْشَى أَنْ لا يَحِلَّ لِي أَنْ أَتَزَوَّجَ مَنْ لَمْ يَكُنْ عَلَى أَمْرِي فَقَالَ مَا يَمْنَعُكَ مِنَ الْبُلْهِ مِنَ النِّسَاءِ قُلْتُ وَمَا الْبُلْهُ قَالَ هُنَّ الْمُسْتَضْعَفَاتُ مِنَ اللاتِي لا يَنْصِبْنَ وَلا يَعْرِفْنَ مَا أَنْتُمْ عَلَيْهِ.

    7. Ali ibn Ibrahim has narrated from his father from ibn abu ‘Umayr from Jamil ibn Darraj from Zurarah who has said the following: “I once said to abu Ja‘far, ‘Alayhi al-Salam, ‘I am afraid that my getting married to one who does not believe as I do is not lawful. He (the Imam) said, ‘Your marriage with a simple-minded woman is not unlawful. 5 I then asked, ‘Who is a simple-minded one? He (the Imam) said, ‘They are those who are weak and who are not hostile (to ‘ATmmah) and do not know what you believe in.”’

    8- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ عَبْدِ الرَّحْمَنِ بْنِ أَبِي نَجْرَانَ عَنْ عَبْدِ اللهِ بْنِ سِنَانٍ قَالَ سَأَلْتُ أَبَا عَبْدِ اللهِ (عَلَيْهِ السَّلام) عَنِ النَّاصِبِ الَّذِي قَدْ عُرِفَ نَصْبُهُ وَعَدَاوَتُهُ هَلْ نُزَوِّجُهُ الْمُؤْمِنَةَ وَهُوَ قَادِرٌ عَلَى رَدِّهِ وَهُوَ لا يَعْلَمُ بِرَدِّهِ قَالَ لا يُزَوَّجِ الْمُؤْمِنُ النَّاصِبَةَ وَلا يَتَزَوَّجِ النَّاصِبُ الْمُؤْمِنَةَ وَلا يَتَزَوَّجِ الْمُسْتَضْعَفُ مُؤْمِنَةً.

    8. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ‘Abd al-Rahman ibn abu Najran from ‘Abd Allah ibn Sinan who has said the following: “This is concerning my question before abu ‘Abd Allah, ‘Alayhi al-Salam, about the case of al-Nasib (one hostile to ‘A’immah) who is well known for his hostility; if we can give a believing woman in marriage to him. He (the guardian of the believing woman) is capable to disprove his (Nasib’s) belief but he (Nasib) is not able to prove himself right. He (the Imam) said, ‘A believing man must not marry a Nasibah and a believing woman must not be given in marriage to him and a believing woman must not marry a man of weak understanding.’”

    9- أَحْمَدُ بْنُ مُحَمَّدٍ عَنِ الْحَسَنِ بْنِ عَلِيِّ بْنِ فَضَّالٍ عَنْ يُونُسَ بْنِ يَعْقُوبَ عَنْ حُمْرَانَ بْنِ أَعْيَنَ قَالَ كَانَ بَعْضُ أَهْلِهِ يُرِيدُ التَّزْوِيجَ فَلَمْ يَجِدِ امْرَأَةً مُسْلِمَةً مُوَافِقَةً فَذَكَرْتُ ذَلِكَ لأبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) فَقَالَ أَيْنَ أَنْتَ مِنَ الْبُلْهِ الَّذِينَ لا يَعْرِفُونَ شَيْئاً.

    9. Ahmad ibn Muhammad from has narrated from af-Hassan ibn Ali ibn Faddaf from Yunus ibn Ya’qub from Humran ibn ‘A‘yan who has said the following: “Someone in my family wanted to get married but could not find a suitable Muslimah and I mentioned it to abu ‘Abd Allah, ‘Alayhi al-Salam, who said, ‘Why does he not find simple-minded women who do not know anything.’”

    10- الْحُسَيْنُ بْنُ مُحَمَّدٍ عَنْ مُعَلَّى بْنِ مُحَمَّدٍ عَنْ حَسَنِ بْنِ عَلِيٍّ الْوَشَّاءِ عَنْ جَمِيلٍ عَنْ زُرَارَةَ عَنْ أَبِي جَعْفَرٍ (عَلَيْهِ السَّلام) قَالَ قُلْتُ لَهُ أَصْلَحَكَ اللهُ إِنِّي أَخَافُ أَنْ لا يَحِلَّ لِي أَنْ أَتَزَوَّجَ يَعْنِي مِمَّنْ لَمْ يَكُنْ عَلَى أَمْرِهِ قَالَ وَمَا يَمْنَعُكَ مِنَ الْبُلْهِ مِنَ النِّسَاءِ وَقَالَ هُنَّ الْمُسْتَضْعَفَاتُ اللاتِي لا يَنْصِبْنَ وَلا يَعْرِفْنَ مَا أَنْتُمْ عَلَيْهِ.

    10. AI-Husayn from Muhammad has narrated from Mu’alfa’ ibn Muhammad from af-Hassan ibn Ali af-Washsha’ from Jamil from Zurarah who has said the following: “I once said to abu ‘Abd Allah, ‘Alayhi al-Salam, ‘I pray to Allah to keep you well, I am afraid it is not lawful for me to get married with those who do not believe in the Divine Authority of ‘A’immah. He (the Imam) said, ‘Why do you not marry with one of the simple minded women?’ He (the Imam) said, ‘They are who are weak, who are not hostile to ‘A’immah and do not know what you believe in.’”

    11- حُمَيْدُ بْنُ زِيَادٍ عَنِ الْحَسَنِ بْنِ مُحَمَّدٍ عَنْ غَيْرِ وَاحِدٍ عَنْ أَبَانِ بْنِ عُثْمَانَ عَنِ الْفُضَيْلِ بْنِ يَسَارٍ قَالَ سَأَلْتُ أَبَا عَبْدِ اللهِ (عَلَيْهِ السَّلام) عَنْ نِكَاحِ النَّاصِبِ فَقَالَ لا وَاللهِ مَا يَحِلُّ قَالَ فُضَيْلٌ ثُمَّ سَأَلْتُهُ مَرَّةً أُخْرَى فَقُلْتُ جُعِلْتُ فِدَاكَ مَا تَقُولُ فِي نِكَاحِهِمْ قَالَ وَالْمَرْأَةُ عَارِفَةٌ قُلْتُ عَارِفَةٌ قَالَ إِنَّ الْعَارِفَةَ لا تُوضَعُ إِلا عِنْدَ عَارِفٍ.

    11. Humayd ibn Ziyad has narrated from af-Hassan ibn Muhammad from more than one person from Aban ibn ‘Uthman from Fudayf ibn Yasar who has said the following: “This is concerning my question before abu ‘Abd Allah, ‘Alayhi al-Salam, about giving in marriage to one hostile to ‘A’immah. He (the Imam) said, ‘No, by Allah, it is not lawful.’ I (Fudayl) then asked him (the Imam) again saying, ‘I pray to Allah to keep my soul in service for your cause, what do you say about their marriage?’ He (the Imam) asked, ‘Is the woman knowledgeable?’ I replied, ‘Yes, she is knowledgeable.’ He (the Imam) said, ‘Knowledgeable lives only with knowledgeable.’”

    12- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنِ ابْنِ فَضَّالٍ عَنِ ابْنِ بُكَيْرٍ عَنْ زُرَارَةَ عَنْ أَبِي جَعْفَرٍ (عَلَيْهِ السَّلام) قَالَ قُلْتُ مَا تَقُولُ فِي مُنَاكَحَةِ النَّاسِ فَإِنِّي قَدْ بَلَغْتُ مَا تَرَى وَمَا تَزَوَّجْتُ قَطُّ قَالَ وَمَا يَمْنَعُكَ مِنْ ذَلِكَ قُلْتُ مَا يَمْنَعُنِي إِلا أَنِّي أَخْشَى أَنْ لا يَكُونَ يَحِلُّ لِي مُنَاكَحَتُهُمْ فَمَا تَأْمُرُنِي قَالَ كَيْفَ تَصْنَعُ وَأَنْتَ شَابٌّ أَتَصْبِرُ قُلْتُ أَتَّخِذُ الْجَوَارِيَ قَالَ فَهَاتِ الآنَ فَبِمَ تَسْتَحِلُّ الْجَوَارِيَ أَخْبِرْنِي فَقُلْتُ إِنَّ الأمَةَ لَيْسَتْ بِمَنْزِلَةِ الْحُرَّةِ إِنْ رَابَتْنِي الأمَةُ بِشَيْ‏ءٍ بِعْتُهَا أَوِ اعْتَزَلْتُهَا قَالَ حَدِّثْنِي فَبِمَ تَسْتَحِلُّهَا قَالَ فَلَمْ يَكُنْ عِنْدِي جَوَابٌ قُلْتُ جُعِلْتُ فِدَاكَ أَخْبِرْنِي مَا تَرَى أَتَزَوَّجُ قَالَ مَا أُبَالِي أَنْ تَفْعَلَ قَالَ قُلْتُ أَرَأَيْتَ قَوْلَكَ مَا أُبَالِي أَنْ تَفْعَلَ فَإِنَّ ذَلِكَ عَلَى وَجْهَيْنِ تَقُولُ لَسْتُ أُبَالِي أَنْ تَأْثَمَ أَنْتَ مِنْ غَيْرِ أَنْ آمُرَكَ فَمَا تَأْمُرُنِي أَفْعَلُ ذَلِكَ عَنْ أَمْرِكَ قَالَ فَإِنَّ رَسُولَ اللهِ (صَلَّى اللهُ عَلَيْهِ وَآلِه) قَدْ تَزَوَّجَ وَكَانَ مِنِ امْرَأَةِ نُوحٍ وَامْرَأَةِ لُوطٍ مَا قَصَّ اللهُ عَزَّ وَجَلَّ وَقَدْ قَالَ اللهُ تَعَالَى ضَرَبَ اللهُ مَثَلا لِلَّذِينَ كَفَرُوا امْرَأَتَ نُوحٍ وَامْرَأَتَ لُوطٍ كانَتا تَحْتَ عَبْدَيْنِ مِنْ عِبادِنا صالِحَيْنِ فَخانَتاهُما فَقُلْتُ إِنَّ رَسُولَ اللهِ (صَلَّى اللهُ عَلَيْهِ وَآلِه) لَسْتُ فِي ذَلِكَ مِثْلَ مَنْزِلَتِهِ إِنَّمَا هِيَ تَحْتَ يَدَيْهِ وَهِيَ مُقِرَّةٌ بِحُكْمِهِ مُظْهِرَةٌ دِينَهُ أَمَا وَاللهِ مَا عَنَى بِذَلِكَ إِلا فِي قَوْلِ اللهِ عَزَّ وَجَلَّ فَخَانَتَاهُمَا مَا عَنَى بِذَلِكَ إِلا وَقَدْ زَوَّجَ رَسُولُ اللهِ (صَلَّى اللهُ عَلَيْهِ وَآلِه) فُلاناً قُلْتُ أَصْلَحَكَ اللهُ فَمَا تَأْمُرُنِي أَنْطَلِقُ فَأَتَزَوَّجُ بِأَمْرِكَ فَقَالَ إِنْ كُنْتَ فَاعِلا فَعَلَيْكَ بِالْبَلْهَاءِ مِنَ النِّسَاءِ قُلْتُ وَمَا الْبَلْهَاءُ قَالَ ذَوَاتُ الْخُدُورِ الْعَفَائِفُ فَقُلْتُ مَنْ هُوَ عَلَى دِينِ سَالِمٍ أَبِي حَفْصٍ فَقَالَ لا فَقُلْتُ مَنْ هُوَ عَلَى دِينِ رَبِيعَةِ الرَّأْيِ قَالَ لا وَلَكِنَّ الْعَوَاتِقَ اللاتِي لا يَنْصِبْنَ وَلا يَعْرِفْنَ مَا تَعْرِفُونَ.

    12. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ibn Faddal from ibn Bukayr from Zurarah who has said the following: “This is concerning my question before abu Ja’far, ‘Alayhi al-Salam, about the marriage of people. ‘I, as you can see, of this age have not married yet.’ He (the Imam) asked, ‘What holds you back from getting married?’ I replied, ‘The only thing that holds me back is that I am afraid marrying them is not lawful and I wish to see what you command me to do.’ He (the Imam) said, ‘What you want to do and you are young, can you bear patience without it?’ I then asked, ‘Can I find slave-girls?’ He (the Imam) said, ‘That is fine but how you make them lawful?’ I said, ‘Slaves are not like free people and if a slave-girl causes me to doubt about an issue, I can sell her or stay away from her.’ He (the Imam) asked, ‘Tell me on what basis you make her lawful.’ He (the narrator) has said, I did not have any answer and I said, ‘I pray to Allah to keep my soul in service for your cause, instruct me about marriage.’ He (the Imam) said, ‘I do not mind if you get married.’ I then said, ‘Consider your words, “I do not mind if you get married” which may have two meanings: “I do not mind if you sinned without a command from me”, so I asked what is your command? Do you command me to get married?’ He (the Imam) said, ‘The Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, married, there was the woman of Nuh and the woman of Lot as Allah, most Majestic, most Glorious, has stated it, “Allah has given the example of the unbelievers, the woman of Nuh and the woman of Lot who were married to two virtuous ones of our servants but they committed treachery.’” (66:11) I then said, ‘I am not of the position of the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause. She was in his control and she acknowledged his commands, expressed her belief in his religion.’ ‘O yes, by Allah, in the words of Allah, most Majestic, most Glorious, “the two committed treachery” do not mean anything else other than . . . The Messenger of Allah married so and so.’ I then asked, ‘I pray to Allah to keep you well, do you command me to go and marry by your command?’ He (the Imam) said, ‘If you want to marry, then marry the simple-minded ones.’ I asked, ‘Who are simple minded ones?’ He (the Imam) said, ‘They are those who maintain privacy and chastity.’ I then asked, ‘What about those who are in the religion of Salim abu Hafs?’ He (the Imam) said, ‘No, it is not from them.’ I then asked about those who are in the religion of Rabi‘a al-Ra’iy?’ He (the Imam) said, ‘No, but she is of the young ones who are not hostile to ’A’immah and do not know what you believe in.’”

    13- أَحْمَدُ بْنُ مُحَمَّدٍ عَنِ ابْنِ فَضَّالٍ عَنِ ابْنِ بُكَيْرٍ عَنْ زُرَارَةَ عَنْ أَبِي جَعْفَرٍ (عَلَيْهِ السَّلام) قَالَ كَانَتْ تَحْتَهُ امْرَأَةٌ مِنْ ثَقِيفٍ وَلَهُ مِنْهَا ابْنٌ يُقَالُ لَهُ إِبْرَاهِيمُ فَدَخَلَتْ عَلَيْهَا مَوْلاةٌ لِثَقِيفٍ فَقَالَتْ لَهَا مَنْ زَوْجُكِ هَذَا قَالَتْ مُحَمَّدُ بْنُ عَلِيٍّ قَالَتْ فَإِنَّ لِذَلِكِ أَصْحَاباً بِالْكُوفَةِ قَوْمٌ يَشْتِمُونَ السَّلَفَ وَيَقُولُونَ قَالَ فَخَلَّى سَبِيلَهَا قَالَ فَرَأَيْتُهُ بَعْدَ ذَلِكَ قَدِ اسْتَبَانَ عَلَيْهِ وَتَضَعْضَعَ مِنْ جِسْمِهِ شَيْ‏ءٌ قَالَ فَقُلْتُ لَهُ قَدِ اسْتَبَانَ عَلَيْكَ فِرَاقُهَا قَالَ وَقَدْ رَأَيْتَ ذَاكَ قَالَ قُلْتُ نَعَمْ.

    13. Ahmad ibn Muhammad has narrated from ibn Faddal from ibn Bukayr from Zurarah who has said the following: “Abu Ja‘far, ‘Alayhi al-Salam, had a wife from the people of Thaqif and from her he (the Imam) had a son called Ibrahim. A slave-girl from Thaqif came to her and asked, ‘Who is your husband?’ She replied, ‘He is Muhammad ibn Ali.’ She then said, ‘That is why in al-Kufah there are people who insult the ancestors and say...’ He (the narrator) has said that he (the Imam) divorced and allowed her to go. He (the narrator) has said that I saw him afterward. The effect of it was clear on him and he had lost a little weight. I said that the effect of her separation is apparent on you. He (the Imam) said, ‘I can see it.’ I said, ‘Yes, it is so.’”

    14- أَحْمَدُ بْنُ مُحَمَّدٍ عَنِ ابْنِ فَضَّالٍ عَنِ ابْنِ بُكَيْرٍ عَنْ زُرَارَةَ عَنْ أَبِي جَعْفَرٍ (عَلَيْهِ السَّلام) قَالَ دَخَلَ رَجُلٌ عَلَى عَلِيِّ بْنِ الْحُسَيْنِ (عَلَيْهِما السَّلام) فَقَالَ إِنَّ امْرَأَتَكَ الشَّيْبَانِيَّةَ خَارِجِيَّةٌ تَشْتِمُ عَلِيّاً (عَلَيْهِ السَّلام) فَإِنْ سَرَّكَ أَنْ أُسْمِعَكَ مِنْهَا ذَاكَ أَسْمَعْتُكَ قَالَ نَعَمْ قَالَ فَإِذَا كَانَ غَداً حِينَ تُرِيدُ أَنْ تَخْرُجَ كَمَا كُنْتَ تَخْرُجُ فَعُدْ فَاكْمُنْ فِي جَانِبِ الدَّارِ قَالَ فَلَمَّا كَانَ مِنَ الْغَدِ كَمَنَ فِي جَانِبِ الدَّارِ فَجَاءَ الرَّجُلُ فَكَلَّمَهَا فَتَبَيَّنَ مِنْهَا ذَلِكَ فَخَلَّى سَبِيلَهَا وَكَانَتْ تُعْجِبُهُ.

    14. Ahmad ibn Muhammad has narrated from ibn Faddal from ibn Bukayr from Zurarah who has said the following: “Abu Ja‘far, ‘Alayhi al-Salam, has said, ‘Once a man came to Ali ibn al-Husayn, ‘Alayhi al-Salam, and said, “Your wife from al-Shayban people is of Kharijiy sect who vilify Ali, ‘Alayhi al-Salam. If you like I can manage for you to hear what she says.” He (the Imam) said, ‘Yes, I agree.’ He (man) said, ‘Tomorrow as you come out of your home as you normally do, wait on the side of the house.’ Next day he (the Imam) waited on the side of the house and the man came. He spoke to her and it (vilification) became clear from her. He (the Imam) divorced her although he liked her quite well.’”

    15- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنْ مُحَمَّدِ بْنِ أَبِي عُمَيْرٍ عَنْ عَبْدِ اللهِ بْنِ سِنَانٍ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ سَأَلَهُ أَبِي وَأَنَا أَسْمَعُ عَنْ نِكَاحِ الْيَهُودِيَّةِ وَالنَّصْرَانِيَّةِ فَقَالَ نِكَاحُهُمَا أَحَبُّ إِلَيَّ مِنْ نِكَاحِ النَّاصِبِيَّةِ وَمَا أُحِبُّ لِلرَّجُلِ الْمُسْلِمِ أَنْ يَتَزَوَّجَ الْيَهُودِيَّةَ وَلا النَّصْرَانِيَّةَ مَخَافَةَ أَنْ يَتَهَوَّدَ وَلَدُهُ أَوْ يَتَنَصَّرَ.

    15. Ali ibn Ibrahim has narrated from his father from Muhammad ibn abu ‘Umayr from ‘Abd Allah ibn Sinan who has said the following: “My father once asked abu ‘Abd Allah, ‘Alayhi al-Salam, about marriage with the Jews and Christians when I was listening. He (the Imam) said, ‘Marriage with them in my view is better than marriage with al-Nasibah (people hostile to ‘A’immah) and I do not like a Muslim man’s marriage with a Jewish woman or a Christian woman because of fear that she can convert his children to Judaism or Christianity.’”

    16- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ عَلِيِّ بْنِ أَبِي حَمْزَةَ عَنْ أَبِي بَصِيرٍ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) أَنَّهُ قَالَ تَزَوُّجُ الْيَهُودِيَّةِ وَالنَّصْرَانِيَّةِ أَفْضَلُ أَوْ قَالَ خَيْرٌ مِنْ تَزَوُّجِ النَّاصِبِ وَالنَّاصِبِيَّةِ.

    16. Ali ibn Ibrahim has narrated from his father from ibn abu ‘Umayr from Ali ibn abu Hamzah from abu Basir who has said the following: “Abu ‘ Abd Allah, ‘Alayhi al-Salam, has said, ‘Marriage with a Jewish or Christian women is preferable’ - or He (the Imam) said that it is better- ‘than marriage with al-Nasibah (people hostile to ‘A’immah).”’

    17- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ ابْنِ أَبِي عُمَيْرٍ عَنْ حَمَّادٍ عَنِ الْحَلَبِيِّ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) أَنَّهُ أَتَاهُ قَوْمٌ مِنْ أَهْلِ خُرَاسَانَ مِنْ وَرَاءِ النَّهَرِ فَقَالَ لَهُمْ تُصَافِحُونَ أَهْلَ بِلادِكُمْ وَتُنَاكِحُونَهُمْ أَمَا إِنَّكُمْ إِذَا صَافَحْتُمُوهُمْ انْقَطَعَتْ عُرْوَةٌ مِنْ عُرَى الإسْلامِ وَإِذَا نَاكَحْتُمُوهُمْ انْهَتَكَ الْحِجَابُ بَيْنَكُمْ وَبَيْنَ اللهِ عَزَّ وَجَلَّ.

    17. Ali ibn Ibrahim has narrated from his father from ibn abu ‘Umayr from Hammad from al-Halabiy who has said the following: “Once, a people from Khurasan, from Transoxiana came to abu ‘Abd Allah, ‘Alayhi al-Salam. He (the Imam) asked them, ‘Do you shake hands with the people of your country and marry them? If you shake hands with them a ring of the rings of Islam is cut and if you marry them the privacy between you and Allah is violated.’”

    1- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ هَارُونَ بْنِ مُسْلِمٍ عَنْ مَسْعَدَةَ بْنِ زِيَادٍ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ قَالَ أَمِيرُ الْمُؤْمِنِينَ (عَلَيْهِ السَّلام) إِيَّاكُمْ وَنِكَاحَ الزِّنْجِ فَإِنَّهُ خَلْقٌ مُشَوَّهٌ.

    1. Ali has narrated from Harun ibn Muslim from Mas’adah ibn Ziyad who has said the following: “Abu ‘ Abd Allah, ‘Alayhi al-Salam, has said that ’Amir al-Mu’minin has said, ’You must remain on your guard against marriage with people of al-Zanj because it is a distorted creature.’”

    2- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ إِسْمَاعِيلَ بْنِ مُحَمَّدٍ الْمَكِّيِّ عَنْ عَلِيِّ بْنِ الْحُسَيْنِ عَنْ عَمْرِو بْنِ عُثْمَانَ عَنِ الْحُسَيْنِ بْنِ خَالِدٍ عَمَّنْ ذَكَرَهُ عَنْ أَبِي الرَّبِيعِ الشَّامِيِّ قَالَ قَالَ لِي أَبُو عَبْدِ اللهِ (عَلَيْهِ السَّلام) لا تَشْتَرِ مِنَ السُّودَانِ أَحَداً فَإِنْ كَانَ لا بُدَّ فَمِنَ النُّوبَةِ فَإِنَّهُمْ مِنَ الَّذِينَ قَالَ اللهُ عَزَّ وَجَلَّ وَمِنَ الَّذِينَ قالُوا إِنَّا نَصارى‏ أَخَذْنا مِيثاقَهُمْ فَنَسُوا حَظًّا مِمَّا ذُكِّرُوا بِهِ أَمَا إِنَّهُمْ سَيَذْكُرُونَ ذَلِكَ الْحَظَّ وَسَيَخْرُجُ مَعَ الْقَائِمِ (عجل الله تعالى فرجه) مِنَّا عِصَابَةٌ مِنْهُمْ وَلا تَنْكِحُوا مِنَ الأكْرَادِ أَحَداً فَإِنَّهُمْ جِنْسٌ مِنَ الْجِنِّ كُشِفَ عَنْهُمُ الْغِطَاءُ.

    2. Ali ibn Ibrahim has narrated from ‘Isma’il ibn Muhammad al-Makkiy from Ali ibn al-Husayn from ‘Amr ibn ‘Uthman from al- Husayn ibn Khalid from those whom he has mentioned from abu Rabi’ al-Shamiy who has said the following: “Abu ’Abd Allah, ‘Alayhi al-Salam, once said to me, ‘You must not buy anyone from al-Sudan, but if you must buy, then buy from al-Nawbah; they are of those about whom Allah, most Majestic, most Glorious, has said, “Of those who have said, ‘We are helpers’, We took a covenant from them; then they forgot the share of what they were reminded.” (5:14) However, they will remember that share and they, a group of them, will come out with the rise of al-Qa’im with divine authority from us. You must not marry anyone of the Kurds; they are a species of Jinn from which the cover is removed.’”

    3- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ عَنْ مُوسَى بْنِ جَعْفَرٍ عَنْ عَمْرِو بْنِ سَعِيدٍ عَنْ مُحَمَّدِ بْنِ عَبْدِ اللهِ الْهَاشِمِيِّ عَنْ أَحْمَدَ بْنِ يُوسُفَ عَنْ عَلِيِّ بْنِ دَاوُدَ الْحَدَّادِ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ لا تُنَاكِحُوا الزِّنْجَ وَالْخَزَرَ فَإِنَّ لَهُمْ أَرْحَاماً تَدُلُّ عَلَى غَيْرِ الْوَفَاءِ قَالَ وَالْهِنْدُ وَالسِّنْدُ وَالْقَنْدُ لَيْسَ فِيهِمْ نَجِيبٌ يَعْنِي الْقُنْدُهَارَ.

    3. A number of our people have narrated from Sahl ibn Ziyad from Musa ibn Ja’far from ‘Amr ibn Sa‘id from Muhammad al-Hashimiy from Ahmad ibn Yusuf from Ali ibn Dawud al-ffaddad who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said, ‘You must not marry, al-Zanj and al-Khazar; they have such wombs that indicate disloyalty.’ He (the Imam) said, ‘Of Indians, al-Sind and al-Qand - meaning al-Qandahar - a hybrid does not exist among them.’”

Ali ibn Ibrahim has narrated from his father from Hammad ibn ‘Isa from Hur ibn ‘Abd Allah from Muhammad ibn Muslim who has said the following: “This is concerning my question before abu Ja’far, ‘Alayhi al-Salam, if I can marry the filthy (prostitute). He (the Imam) said, ’No, you cannot do so/”

    2- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنْ مُحَمَّدِ بْنِ أَبِي عُمَيْرٍ عَنْ جَمِيلِ بْنِ دَرَّاجٍ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَحَدِهِمَا (عَلَيْهِما السَّلام) فِي الرَّجُلِ يَشْتَرِي الْجَارِيَةَ أَوْ يَتَزَوَّجُهَا لِغَيْرِ رِشْدَةٍ وَيَتَّخِذُهَا لِنَفْسِهِ فَقَالَ إِنْ لَمْ يَخَفِ الْعَيْبَ عَلَى وُلْدِهِ فَلا بَأْسَ.

    2. Ali ibn Ibrahim has narrated from his father from Muhammad ibn abu ‘Umayr from Jamil ibn Darraj from Muhammad ibn Muslim who has said the following: “One of the two Imam, (abu Ja’far or abu ’Abd Allah), ‘Alayhim al-Salam, about the case of a man who buys a slave-girl or marries her without proper wedlock and keeps her for his own self, he (the Imam) has said, ‘If he is not afraid of the stigma for his children, it is not unlawful.”’

    3- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ وَعِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ عَنِ الْحَسَنِ بْنِ مَحْبُوبٍ عَنْ عَبْدِ اللهِ بْنِ سِنَانٍ قَالَ قُلْتُ لأبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) وَلَدُ الزِّنَا يُنْكَحُ قَالَ نَعَمْ وَلا يُطْلَبُ وَلَدُهَا.

Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad Ahmad ibn Muhammad from certain persons of our people from Sahl ibn Ziyad from al-Hassan ibn Mahbub from ‘Abd Allah ibn Sinan who has said the following: “This is concerning my question before abu ‘Abd Allah, ‘Alayhi al-Salam, about marriage with one born out of wedlock. He (the Imam) said, ‘Yes, but her children are not wanted.’”

    4- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ عَلِيِّ بْنِ الْحَكَمِ عَنِ الْعَلاءِ بْنِ رَزِينٍ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ قَالَ سَأَلْتُ أَبَا جَعْفَرٍ (عَلَيْهِ السَّلام) عَنِ الْخَبِيثَةِ يَتَزَوَّجُهَا الرَّجُلُ قَالَ لا وَقَالَ إِنْ كَانَ لَهُ أَمَةٌ وَطِئَهَا وَلا يَتَّخِذْهَا أُمَّ وَلَدِهِ.

    4. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from al-‘Ala’ ibn Razin from Muhammad ibn Muslim who has said the following: “I once asked abu Ja’far, ‘Alayhi al-Salam, about the case of a man if he could marry the filthy (prostitute). He (the Imam) said, ‘No, he cannot do so.’ He (the Imam) said, ‘If he has a slave-girl with whom he has gone to bed but she must not be taken as the mother of his children.’” (He must use contraceptives)

    5- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنْ مُحَمَّدِ بْنِ أَبِي عُمَيْرٍ عَنْ حَمَّادٍ عَنِ الْحَلَبِيِّ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ سُئِلَ عَنِ الرَّجُلِ يَكُونُ لَهُ الْخَادِمُ وَلَدَ زِنًى عَلَيْهِ جُنَاحٌ أَنْ يَطَأَهَا قَالَ لا وَإِنْ تَنَزَّهَ عَنْ ذَلِكَ فَهُوَ أَحَبُّ إِلَيَّ.

    5. Ali ibn Ibrahim has narrated from his father from Muhammad ibn abu ‘Umayr from Hammad from al-Halabiy who has said the following: “Once abu ‘Abd Allah, ‘Alayhi al-Salam, was asked about the case of a man who has a servant born out of wedlock; if he can go to bed with her. He (the Imam) said, ‘No, if he stays clean of that, it is more likeable to me.’”

    1- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنِ النَّوْفَلِيِّ عَنِ السَّكُونِيِّ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ قَالَ أَمِيرُ الْمُؤْمِنِينَ (صَلَّى اللهُ عَلَيْهِ وَآلِه) إِيَّاكُمْ وَتَزْوِيجَ الْحَمْقَاءِ فَإِنَّ صُحْبَتَهَا بَلاءٌ وَوُلْدَهَا ضِيَاعٌ.

    1. Ali ibn Ibrahim has narrated from his father from af-Nawfafiy from af-Sakuniy who has said the following: “Abu ‘ Abd Allah, ‘Alayhi al-Salam, has said that ’Amir al-Mu’minin has said, ’Beware of marriage with dimwitted ones, living with her is a tragedy and her children are a loss.’”

    2- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ أَحْمَدَ بْنِ أَبِي عَبْدِ اللهِ عَنْ أَبِيهِ عَمَّنْ حَدَّثَهُ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ زَوِّجُوا الأحْمَقَ وَلا تُزَوِّجُوا الْحَمْقَاءَ فَإِنَّ الأحْمَقَ يَنْجُبُ وَالْحَمْقَاءَ لا تَنْجُبُ.

    2. A number of our people have narrated from Ahmad ibn abu ‘Abd Allah from his father from those who narrated to him who has said the following: “Abu ’Abd Allah, ‘Alayhi al-Salam, has said, ‘You can give in marriage to a dimwitted man but do not marry a dimwitted woman; a dimwitted man can have children (healthy ones) but a dimwitted woman cannot.”’

    3- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنِ ابْنِ مَحْبُوبٍ عَنْ أَبِي أَيُّوبَ الْخَزَّازِ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَبِي جَعْفَرٍ (عَلَيْهِ السَّلام) قَالَ سَأَلَهُ بَعْضُ أَصْحَابِنَا عَنِ الرَّجُلِ الْمُسْلِمِ تُعْجِبُهُ الْمَرْأَةُ الْحَسْنَاءُ أَيَصْلُحُ لَهُ أَنْ يَتَزَوَّجَهَا وَهِيَ مَجْنُونَةٌ قَالَ لا وَلَكِنْ إِنْ كَانَتْ عِنْدَهُ أَمَةٌ مَجْنُونَةٌ فَلا بَأْسَ بِأَنْ يَطَأَهَا وَلا يَطْلُبَ وَلَدَهَا.

    3. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ibn Mahbub abu Ayyub al-Khazzaz from Muhammad ibn Muslim who has said the following: “Certain persons of our people once asked abu Ja’far, ‘Alayhi al-Salam, about the case of a Muslim man who likes a beautiful woman; if he can marry her and she is insane. He (the Imam) said, ’No, however, if he has an insane slave-girl he can go to bed with her but must not seek her children (he must use contraceptives).”’

    1.     2.     3- الْحُسَيْنُ بْنُ مُحَمَّدٍ عَنْ مُعَلَّى بْنِ مُحَمَّدٍ عَنِ الْحَسَنِ بْنِ عَلِيٍّ عَنْ أَبَانِ بْنِ عُثْمَانَ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ عَنْ أَبِي جَعْفَرٍ (عَلَيْهِ السَّلام) فِي قَوْلِهِ عَزَّ وَجَلَّ الزَّانِي لا يَنْكِحُ إِلا زانِيَةً أَوْ مُشْرِكَةً قَالَ هُمْ رِجَالٌ وَنِسَاءٌ كَانُوا عَلَى عَهْدِ رَسُولِ اللهِ (صَلَّى اللهُ عَلَيْهِ وَآلِه) مَشْهُورِينَ بِالزِّنَا فَنَهَى اللهُ عَزَّ وَجَلَّ عَنْ أُولَئِكَ الرِّجَالِ وَالنِّسَاءِ وَالنَّاسُ الْيَوْمَ عَلَى تِلْكَ الْمَنْزِلَةِ مَنْ شَهَرَ شَيْئاً مِنْ ذَلِكَ أَوْ أُقِيمَ عَلَيْهِ الْحَدُّ فَلا تُزَوِّجُوهُ حَتَّى تُعْرَفَ تَوْبَتُهُ.

    3. Al-Husayn from Muhammad has narrated from Mu’alla’ ibn Muhammad al-Hassan ibn Ali from Aban ibn ‘Uthman from Muhammad ibn Muslim who has said the following: “Abu Ja’far, ‘Alayhi al-Salam, about the word of Allah, most Majestic, most Glorious, ‘A prostitute man cannot marry but a prostitute woman or a pagan,’ (24:4) has said, ‘During the time of the Messenger of Allah, O Allah, grant compensation to Muhammad and his family worthy of their services to Your cause, there were well-known prostitutes female and male. Allah, most Majestic, most Glorious, has prohibited forming marriage contract with such men and women. Today people who become known as such or are convicted for fornication and punished (by the qualified court) are of the same status. No one must marry them unless it is known that they have repented.’”

    4- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنْ عَلِيِّ بْنِ الْحَكَمِ عَنْ مُعَاوِيَةَ بْنِ وَهْبٍ قَالَ سَأَلْتُ أَبَا عَبْدِ اللهِ (عَلَيْهِ السَّلام) عَنْ رَجُلٍ تَزَوَّجَ امْرَأَةً فَعَلِمَ بَعْدَ مَا تَزَوَّجَهَا أَنَّهَا كَانَتْ زَنَتْ قَالَ إِنْ شَاءَ زَوْجُهَا أَنْ يَأْخُذَ الصَّدَاقَ مِنَ الَّذِي زَوَّجَهَا وَلَهَا الصَّدَاقُ بِمَا اسْتَحَلَّ مِنْ فَرْجِهَا وَإِنْ شَاءَ تَرَكَهَا.

    4. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from Mu‘awiyah ibn Wahab who has said the following: “This is concerning my question before abu ‘Abd Allah, ‘Alayhi al-Salam, about the case of a man who marries a woman and afterwards finds out that she had committed fornication. He (the Imam) said, ‘If the husband wants he can take back from her guardian the mahr that he has paid, but she deserves the mahr because of which her marriage was made lawful, and if he wants he can separate from her (by means of divorce).”’

    5- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنِ ابْنِ فَضَّالٍ عَنِ ابْنِ بُكَيْرٍ عَنْ زُرَارَةَ بْنِ أَعْيَنَ عَنْ أَبِي جَعْفَرٍ (عَلَيْهِ السَّلام) قَالَ سَمِعْتُهُ يَقُولُ لا خَيْرَ فِي وَلَدِ الزِّنَا وَلا فِي بَشَرِهِ وَلا فِي شَعْرِهِ وَلا فِي لَحْمِهِ وَلا فِي دَمِهِ وَلا فِي شَيْ‏ءٍ مِنْهُ عَجَزَتْ عَنْهُ السَّفِينَةُ وَقَدْ حُمِلَ فِيهَا الْكَلْبُ وَالْخِنْزِيرُ.

    5. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ibn Faddal from ibn Bukayr from Zurarah ibn ‘A‘yan who has said the following: “I once heard abu Ja‘far, ‘Alayhi al-Salam, saying, ‘There is no goodness in one who is born out of wedlock, not in his skin, his hair, his flesh, his blood and not in anything of him, the Ark (of Noah) failed to carry him even though dogs and pigs had embarked therein.’”

    6- حُمَيْدُ بْنُ زِيَادٍ عَنِ الْحَسَنِ بْنِ مُحَمَّدِ بْنِ سَمَاعَةَ عَنْ أَحْمَدَ بْنِ الْحَسَنِ الْمِيثَمِيِّ عَنْ أَبَانٍ عَنْ حَكَمِ بْنِ حُكَيْمٍ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) فِي قَوْلِهِ عَزَّ وَجَلَّ وَالزَّانِيَةُ لا يَنْكِحُها إِلا زانٍ أَوْ مُشْرِكٌ قَالَ إِنَّمَا ذَلِكَ فِي الْجَهْرِ ثُمَّ قَالَ لَوْ أَنَّ إِنْسَاناً زَنَى ثُمَّ تَابَ تَزَوَّجَ حَيْثُ شَاءَ.

    6. Flumayd ibn Ziyad has narrated from al-Hassan ibn Muhammad ibn Sama‘ah from Ahmad ibn al-Hassan al-Mithamiy from Aban from Hakam ibn Hakim who has said the following: “About the words of Allah, most Majestic, most Glorious, ‘A prostitute man cannot marry but a prostitute woman or a pagan,’ (24:4) abu ‘Abd Allah, ‘Alayhi al-Salam, has said, This is about well- known, and openly committing prostitution.’ He (the Imam) then said, ’If one after committing fornication repents he can marry as he wants.’”

    1- مُحَمَّدُ بْنُ يَحْيَى عَنْ مُحَمَّدِ بْنِ أَحْمَدَ عَنْ أَحْمَدَ بْنِ الْحَسَنِ عَنْ عَمْرِو بْنِ سَعِيدٍ عَنْ مُصَدِّقِ بْنِ صَدَقَةَ عَنْ عَمَّارِ بْنِ مُوسَى عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ سَأَلْتُهُ عَنِ الرَّجُلِ يَحِلُّ لَهُ أَنْ يَتَزَوَّجَ امْرَأَةً كَانَ يَفْجُرُ بِهَا فَقَالَ إِنْ آنَسَ مِنْهَا رُشْداً فَنَعَمْ وَإِلا فَلْيُرَاوِدَنَّهَا عَلَى الْحَرَامِ فَإِنْ تَابَعَتْهُ فَهِيَ عَلَيْهِ حَرَامٌ وَإِنْ أَبَتْ فَلْيَتَزَوَّجْهَا.

    1. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ahmad ibn al-Hassan from ‘Amr ibn Sa‘id from Musaddiq ibn Sadaqah from ‘Ammar ibn Musa who has said the following: “This is concerning my question before abu ‘ Abd Allah, ‘Alayhi al-Salam, about the case of a man who has committed fornication with a woman; if he can marry her. He (the Imam) said, Tf he finds her to have gained wisdom then he can do so, otherwise, he can try her by offering unlawful choices; if she follows then it is unlawful for him to marry; but if she refuses he then can marry her.’”

    2- عَلِيُّ بْنُ إِبْرَاهِيمَ عَنْ أَبِيهِ عَنْ مُحَمَّدِ بْنِ أَبِي عُمَيْرٍ عَنْ حَمَّادِ بْنِ عُثْمَانَ عَنْ عُبَيْدِ اللهِ بْنِ عَلِيٍّ الْحَلَبِيِّ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ أَيُّمَا رَجُلٍ فَجَرَ بِامْرَأَةٍ ثُمَّ بَدَا لَهُ أَنْ يَتَزَوَّجَهَا حَلالا قَالَ أَوَّلُهُ سِفَاحٌ وَآخِرُهُ نِكَاحٌ وَمَثَلُهُ مَثَلُ النَّخْلَةِ أَصَابَ الرَّجُلُ مِنْ ثَمَرِهَا حَرَاماً ثُمَّ اشْتَرَاهَا بَعْدُ فَكَانَتْ لَهُ حَلالا.

    2. Ali ibn Ibrahim has narrated from his father from Muhammad ibn abu ‘Umayr from Hammad ibn ‘Uthman from ‘Ubayd Allah ibn Ali al-Halabiy who has said the following: “Abu ‘Abd Allah, ‘Alayhi al-Salam, has said, Tf a man commits indecent act (goes to bed with her out of wedlock) with a woman and then decides to marry her, it is a case of indecency in the beginning and then marriage, like a palm tree that one uses its fruit in an unlawful manner then buys the whole tree in a lawful manner and it thereafter is all lawful.”’

    3. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from Ali ibn abu Hamzah from abu Basir who has said the following: “This is concerning my question before abu ‘Abd Allah, ‘Alayhi al-Salam, about the case of a man who commits an indecent act (goes to bed with her out of wedlock), then decides to marry her. He (the Imam) said, ‘It is lawful, although in the beginning, it is indecency, and at the end is marriage; in the beginning, (it is) unlawful and in the end becomes lawful.’”

    4- مُحَمَّدُ بْنُ يَحْيَى عَنْ بَعْضِ أَصْحَابِنَا عَنْ عُثْمَانَ بْنِ عِيسَى عَنْ إِسْحَاقَ بْنِ جَرِيرٍ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) قَالَ قُلْتُ لَهُ الرَّجُلُ يَفْجُرُ بِالْمَرْأَةِ ثُمَّ يَبْدُو لَهُ فِي تَزْوِيجِهَا هَلْ يَحِلُّ لَهُ ذَلِكَ قَالَ نَعَمْ إِذَا هُوَ اجْتَنَبَهَا حَتَّى تَنْقَضِيَ عِدَّتُهَا بِاسْتِبْرَاءِ رَحِمِهَا مِنْ مَاءِ الْفُجُورِ فَلَهُ أَنْ يَتَزَوَّجَهَا وَإِنَّمَا يَجُوزُ لَهُ أَنْ يَتَزَوَّجَهَا بَعْدَ أَنْ يَقِفَ عَلَى تَوْبَتِهَا.

    4. Muhammad ibn Yahya has narrated from certain persons of our people from ‘Uthman ibn ‘Isa from Ishaq ibn Jarir who has said the following: “This is concerning my question before abu ‘Abd Allah, ‘Alayhi al-Salam, about the case of a man who commits an indecent act (goes to bed with her out of wedlock) with a woman and then decides to marry her; if it is lawful for him. He (the Imam) said, ‘Yes, it is lawful if he waits until her waiting period is complete to cleans her womb from indecent activities; then he can marry her and it is only when he ascertains that she has repented.’”

    1- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنِ الْحَسَنِ بْنِ مَحْبُوبٍ عَنْ مُعَاوِيَةَ بْنِ وَهْبٍ وَغَيْرِهِ عَنْ أَبِي عَبْدِ اللهِ (عَلَيْهِ السَّلام) فِي الرَّجُلِ الْمُؤْمِنِ يَتَزَوَّجُ الْيَهُودِيَّةَ وَالنَّصْرَانِيَّةَ قَالَ إِذَا أَصَابَ الْمُسْلِمَةَ فَمَا يَصْنَعُ بِالْيَهُودِيَّةِ وَالنَّصْرَانِيَّةِ فَقُلْتُ لَهُ يَكُونُ لَهُ فِيهَا الْهَوَى فَقَالَ إِنْ فَعَلَ فَلْيَمْنَعْهَا مِنْ شُرْبِ الْخَمْرِ وَأَكْلِ لَحْمِ الْخِنْزِيرِ وَاعْلَمْ أَنَّ عَلَيْهِ فِي دِينِهِ غَضَاضَةً.

    1. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from al-Hassan ibn Mahbub from Mu‘awiyah ibn Wahab and others who has said the following: “About the case of a man who marries a Jewish or a Christian woman, abu ‘ Abd Allah, ‘Alayhi al- Salam, has said, ‘What has he to do with a Jewish or Christian woman if he can find a Muslim woman?’ I (the narrator) asked, ‘What happens if he loves her?’ He (the Imam) said, ‘If he marries, he must stop her from drinking wine and eating pork and you must take notice that he will have deficiency in his religion.”’

    2- الْحُسَيْنُ بْنُ مُحَمَّدٍ عَنْ مُعَلَّى بْنِ مُحَمَّدٍ عَنِ الْحَسَنِ بْنِ عَلِيٍّ الْوَشَّاءِ عَنْ أَبَانِ بْنِ عُثْمَانَ عَنْ زُرَارَةَ بْنِ أَعْيَنَ قَالَ سَأَلْتُ أَبَا جَعْفَرٍ (عَلَيْهِ السَّلام) عَنْ نِكَاحِ الْيَهُودِيَّةِ وَالنَّصْرَانِيَّةِ فَقَالَ لا يَصْلُحُ لِلْمُسْلِمِ أَنْ يَنْكِحَ يَهُودِيَّةً وَلا نَصْرَانِيَّةً وَإِنَّمَا يَحِلُّ لَهُ مِنْهُنَّ نِكَاحُ الْبُلْهِ.

    2. Al-Husayn from Muhammad has narrated from Mu’alla’ ibn Muhammad from al-Hassan ibn Ali al-Washsha’ from Aban ibn ‘Uthman from Zurarah ibn ‘A‘yan who has said the following: “I once asked abu Ja‘far, ‘Alayhi al-Salam, about marriage with a Jewish or Christian woman. He (the Imam) said, ‘It is not proper for a Muslim to marry a Jewish or Christian woman; only with the simple-minded ones of them marriage is lawful.’”

    3- عِدَّةٌ مِنْ أَصْحَابِنَا عَنْ سَهْلِ بْنِ زِيَادٍ عَنِ الْحَسَنِ بْنِ مَحْبُوبٍ عَنِ الْعَلاءِ بْنِ رَزِينٍ عَنْ مُحَمَّدِ بْنِ مُسْلِمٍ قَالَ سَأَلْتُ أَبَا جَعْفَرٍ (عَلَيْهِ السَّلام) أَيَتَزَوَّجُ الْمَجُوسِيَّةَ قَالَ لا وَلَكِنْ إِنْ كَانَتْ لَهُ أَمَةً.

    3. A number of our people have narrated from Sahl ibn Ziyad from al-Hassan ibn Mahbub from al-‘Ala’ ibn Razin from Muhammad ibn Muslim who has said the following: “I once asked abu Ja‘far, ‘Alayhi al-Salam, if it is lawful to marry a Zoroastrian woman. He (the Imam) said, ‘No, however, she can be his slave-girl.’”

    4. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from Ali ibn al-Hakam from al-‘Ala’ ibn Razin from Muhammad ibn Muslim who has said the following: “Abu Ja‘far, ‘Alayhi al-Salam, has said, ‘A Jewish or a Christian woman cannot become a second wife, the first being a Muslim woman.’”

    5. A number of our people have narrated from Ahmad ibn Muhammad from ibn Khalid al-Barqiy from ‘Uthman ibn ‘Isa from Sama‘ah ibn Mehran who has said the following: “This is concerning my question before him (the Imam), ‘Alayhi al-Salam, if one can marry a Jewish or a Christian woman as a second wife, the first being a Muslim woman. He (the Imam) said, ‘No, but a Muslim woman can become a second wife, the first being a Jewish or a Christian woman.’”

    6- مُحَمَّدُ بْنُ يَحْيَى عَنْ أَحْمَدَ بْنِ مُحَمَّدٍ عَنِ ابْنِ فَضَّالٍ عَنِ الْحَسَنِ بْنِ جَهْمٍ قَالَ قَالَ لِي أَبُو الْحَسَنِ الرِّضَا (عَلَيْهِ السَّلام) يَا أَبَا مُحَمَّدٍ مَا تَقُولُ فِي رَجُلٍ يَتَزَوَّجُ نَصْرَانِيَّةً عَلَى مُسْلِمَةٍ قُلْتُ جُعِلْتُ فِدَاكَ وَمَا قَوْلِي بَيْنَ يَدَيْكَ قَالَ لَتَقُولَنَّ فَإِنَّ ذَلِكَ يُعْلَمُ بِهِ قَوْلِي قُلْتُ لا يَجُوزُ تَزْوِيجُ النَّصْرَانِيَّةِ عَلَى مُسْلِمَةٍ وَلا غَيْرِ مُسْلِمَةٍ قَالَ وَلِمَ قُلْتُ لِقَوْلِ اللهِ عَزَّ وَجَلَّ وَلا تَنْكِحُوا الْمُشْرِكاتِ حَتَّى يُؤْمِنَّ قَالَ فَمَا تَقُولُ فِي هَذِهِ الآيَةِ وَالْمُحْصَناتُ مِنَ الَّذِينَ أُوتُوا الْكِتابَ مِنْ قَبْلِكُمْ قُلْتُ فَقَوْلُهُ وَلا تَنْكِحُوا الْمُشْرِكاتِ نَسَخَتْ هَذِهِ الآيَةَ فَتَبَسَّمَ ثُمَّ سَكَتَ.

    6. Muhammad ibn Yahya has narrated from Ahmad ibn Muhammad from ibn Faddal from al-Hassan ibn al-Jahm who has said the following: “Abu al-Hassan, al-Rida’, ‘Alayhi al-Salam, once said to me, ‘O abu Muhammad, what do you say about a man who marries a Jewish or a Christian woman, as a second wife, the first being a Muslim woman?’ I replied, ‘I pray to Allah to keep my soul in service for your cause, my words have no meaning in your presence.’ He (the Imam) said, ‘You must say it; with it my words will come to light.’ I said, ‘It is not lawful to marry a Christian woman as a second wife, the first being a Muslim woman or non-Muslim woman.’ He (the Imam) asked, ‘Why is it so?’ I replied, ‘It is because of the words of Allah, most Majestic, most Glorious, “You must not marry the pagan women until they become believers.’” (2:221) He (the Imam) then asked, ‘What do you say about, “Marry of the chaste woman of the followers of the book (bible) which was before you” (5:5)?’ I replied, ‘Verse 221 of Chapter 2 has cancelled verse 5:5.’ He (the Imam) smiled and remained quiet.’”
